35 <br /> FTA FISCAL YEAR 2017 CERTIFICATIONS AND ASSURANCES <br /> 3. It will maintain its equipment and facilities acquired or improved under its Award, in <br /> accordance with the recipient's transit asset management plan and consistent with FTA <br /> regulations, "Transit Asset Management," 49 CFR part 625, <br /> 4. When using or involving a facility or equipment acquired or improved with federal assistance <br /> under 49 U.S.C. § 5307 during non-peak hours for transportation, it will charge a fare not <br /> exceeding fifty (50)percent of the peak hour fare to the following individuals: <br /> a. Any senior, <br /> b. Any individual who, because of illness, injury, age, congenital malfunction, or any other <br /> incapacity or temporary or permanent disability (including an individual who is a <br /> wheelchair user or has semi-ambulatory capability), is unable to use a public <br /> transportation service or a public transportation facility effectively without special <br /> facilities,planning, or design, <br /> c. Any individual presenting a Medicare card issued to that individual under title II of the <br /> Social Security Act (42 U.S.C. § 401 et seq.), and <br /> d. Any individual presenting a Medicare card issued to that individual under title XVIII of <br /> the Social Security Act(42 U.S.C. § 1395 etseq.). <br /> 5. When carrying out a procurement under 49 U.S.C. § 5307, it will comply with: <br /> a. The applicable general provisions of 49 U.S.C. § 5323, and <br /> b. The applicable third party contract provisions of 49 U.S.C. § 5325. <br /> 6. It has complied with or will comply with 49 U.S.C. § 5307(b)because: <br /> a. It has made or will make available to the public information on the amounts of federal <br /> assistance available to it under 49 U.S.C. § 5307, <br /> b. It has developed or will develop, in consultation with interested parties including private <br /> transportation providers, its proposed Program of Projects for activities for which federal <br /> assistance is sought, <br /> c. It has published or will publish its proposed Program of Projects in a way that affected <br /> individuals,private transportation providers, and local elected officials will have an <br /> opportunity to examine and submit comments on its proposed Program of Projects and its <br /> performance as an Applicant or Recipient, <br /> d. It has provided or will provide an opportunity for a public hearing to obtain the views of <br /> individuals on its proposed Program of Projects, <br /> e. It has ensured or will ensure that its proposed Program of Projects provides for <br /> coordination of transportation services financed by FTA under 49 U.S.C. § 5336, as <br /> amended by the FAST Act, with transportation services supported by other Federal <br /> Government sources, <br /> f. It has considered or will consider the comments and views received, especially those of <br /> private transportation providers, in preparing its final Program of Projects, and <br /> g. It has made or will make its final Program of Projects available to the public. <br /> 7. As required by 49 U.S.C. § 5307(d): <br /> a. It has or will have the amount of funds required for the non-federal share, <br /> b. It will provide the non-federal share from sources approved by FTA, and <br /> c. It will provide the non-federal share when needed. <br /> 8. As required by 49 U.S.C. § 5307(c)(1)(H), it will comply with: <br /> a.
