28 <br /> FTA FISCAL YEAR 2017 CERTIFICATIONS AND ASSURANCES <br /> acquires any capital asset (other than rolling stock or related equipment) through a lease financed <br /> with federal assistance appropriated or made available under 49 U.S.C. chapter 53, it will not <br /> enter into a capital lease for which FTA can provide only incremental federal assistance unless it <br /> has adequate financial resources to meet its future lease obligations if federal assistance is not <br /> available. <br /> CATEGORY 09. TRANSIT ASSET MANAGEMENT PLAN, PUBLIC <br /> TRANSPORTATION AGENCY SAFETY PLAN, <br /> AND STATE SAFETY OVERSIGHT REQUIREMENTS. <br /> Before FTA may provide federal assistance appropriated or made available under 49 U.S.C. <br /> chapter 53 to support an Award,you must select the Certifications in Category 09, except as <br /> FTA determines otherwise in writing. <br /> Any provision of the Certifications in Category 09 that does not apply will not be enforced. <br /> 09.A. Transit Asset Management Plan. <br /> If your Applicant applies for funding appropriated or made available for 49 U.S.C. chapter 53, <br /> the Transit Asset Management Certifications in Category 09.A apply to your Applicant, except as <br /> FTA determines otherwise in writing. <br /> On behalf of your Applicant, you certify that it and each of its Subrecipients will: <br /> 1. Comply with FTA regulations, "Transit Asset Management," 49 CFR part 625, and <br /> 2. Follow federal guidance that will implement the regulations at 49 CFR part 625. <br /> 09.B. Public Transportation Safety Program. <br /> If your Applicant applies for funding under 49 U.S.C. chapter 53 and it is a State, local <br /> government authority, or any other operator of a public transportation system, the particular <br /> provisions under the Public Transportation Safety Program in Category 09.B apply to your <br /> Applicant, except as FTA determines otherwise in writing. <br /> On behalf of your Applicant, you certify that it will comply with applicable regulations, <br /> guidance, and directives that implement the Public Transportation Safety Program provisions of <br /> 49 U.S.C. § 5329(b)-(d), except as FTA determines otherwise in writing. <br /> 09.C. State Safety Oversight Requirements. <br /> On behalf of your Applicant, depending on how far the Recipient has progressed in developing a <br /> State Safety Oversight program fully compliant with 49 U.S.C. § 5329(e) and FTA regulations, <br /> "State Safety Oversight," 49 C.F.R. part 674, your applicant certifies that it will comply as <br /> follows: <br /> 22 <br />
