<br /> 01.C. Intergovernmental Review Assurance.
<br /> (This assurance in this Category 01.C does not apply to an Indian tribe, an Indian organization,
<br /> or an Indian tribal organization that applies for federal assistance made available under
<br /> 49 U.S.C. §5311(c)(1), which authorizes FTA's Tribal Transit Programs.)
<br /> As required by U.S. Department of Transportation (U.S. DOT)regulations, "Intergovernmental
<br /> Review of Department of Transportation Programs and Activities," 49 CFR part 17, on behalf of
<br /> your Applicant, you assure that it has submitted or will submit each application for federal
<br /> assistance to the appropriate state and local agencies for intergovernmental review.
<br /> 01.D. Nondiscrimination Assurance.
<br /> On behalf of your Applicant, you assure that:
<br /> 1. It will comply with the following laws, regulations, and requirements so that no person in the
<br /> United States will be denied the benefits of, or otherwise be subjected to discrimination in,
<br /> any U.S. DOT or FTA assisted program or activity (particularly in the level and quality of
<br /> transportation services and transportation-related benefits) on the basis of race, color,
<br /> national origin, religion, sex, disability, or age including:
<br /> a. Federal transit laws, specifically 49 U.S.C. § 5332 (prohibiting discrimination on the
<br /> basis of race, color, religion, national origin, sex (including gender identity), disability,
<br /> age, employment, or business opportunity),
<br /> b. Title VI of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000d,
<br /> c. Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq.
<br /> (prohibiting discrimination on the basis of race, color, religion, sex, (including gender
<br /> identity and sexual orientation) or national origin),
<br /> d. Executive Order No. 11246, "Equal Employment Opportunity" September 24, 1965,
<br /> 42 U.S.C. § 2000e note, as amended by any later Executive Order that amends or
<br /> supersedes it in part and is applicable to federal assistance programs,
<br /> e. Title IX of the Education Amendments of 1972, as amended, 20 U.S.C. § 1681 et seq.,
<br /> f. U.S. DOT regulations, "Nondiscrimination on the Basis of Sex in Education Programs or
<br /> Activities Receiving Federal Financial Assistance," 49 C.F.R. part 25,
<br /> g. The Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794, et seq.,
<br /> h. The Americans with Disabilities Act of 1990, as amended, 42 U.S.C. § 12101 et seq.,
<br /> i. U.S. DOT regulations, "Nondiscrimination in Federally-Assisted Programs of the
<br /> Department of Transportation-Effectuation of Title VI of the Civil Rights Act of 1964,"
<br /> 49 CFR part 21,
<br /> j. U.S. DOT regulations, specifically 49 CFR parts 27, 37, 38, and 39, and
<br /> k. Any other applicable federal statutes that may be signed into law, federal regulations that
<br /> may be issued, or federal requirements that may be imposed.
<br /> 2. It will comply with federal guidance implementing federal nondiscrimination laws,
<br /> regulations, or requirements, except as FTA determines otherwise in writing.
