If this is not feasible, the County shall work with <br /> the neighboring property owner to develop terms and conditions on use of the <br /> trail that will minimize potential impacts to the property owner. <br /> 3. Include a condition to address fire management—There are conditions which <br /> prohibit camping, smoking, and building fires. Fires are most likely from <br /> natural causes such as lightning, but someone could cause a fire on or near the <br /> trail as they could currently. There is a condition which requires the <br /> development of an Emergency Response Plan that would address fires. <br /> 4. Consider not allowing pets or requiring that they be on a 6 foot leash —Since <br /> dogs do tend to want to seek out water, staff agrees that a condition along <br /> these lines should be included. We did include one that prohibits pets but <br /> does allow service animals. The requirements in 15A NCAC 18C .1207 (rules to <br /> protect public water supplies) require dogs to be at least 50 feet from the <br /> water; if the trail is a minimum of 50 feet from the water, there may be times <br /> where a longer leash would result in a violation of that requirement. <br /> 5. Consider a condition which has a minimum distance from trail heads and <br /> parking areas to the lake —Staff did not think this condition was necessary. <br /> Orange County's ordinances within the Cane Creek Reservoir were written to <br /> protect the reservoir from nonpoint source runoff pollution. <br /> 4.19 <br />
