24 <br /> Attachment 5 <br /> Individual Board Member Suggestions for Potential Conditions for Use of <br /> OWASA Land for the Mountains-to-Sea Trail <br /> 1. Minimum distance from trail to residential dwellings —Staff talked to trail <br /> planners and searched the web but did not find any best practices for this <br /> metric or trail planning guides that included this metric. While such a <br /> condition may address some private property concerns, the distance would <br /> vary depending on the site conditions including the terrain and the amount <br /> and type of vegetation. In addition, local government ordinances typically <br /> include setbacks from property lines rather than structures since a neighboring <br /> landowner could build a new structure after a given use is permitted. Staff did <br /> not include another condition, but left the condition of recommending that <br /> the trail be 50 feet inside our property line when practicable. <br /> The County does require building setbacks, but there are no setback <br /> requirements for trails. The building setbacks in the Rural Agricultural zoning <br /> district which includes OWASA land are a minimum of 20 feet; if the trail is at <br /> least 50 feet inside our property line, it would be at least 70 feet from a <br /> dwelling unit. Staff did a quick GIS analysis of the distance between structures <br /> (did not know which were dwelling units) from the proposed trail using <br /> alignments proposed several years ago (used the shorter distance from trail <br /> marked by OWASA staff versus trail marked by County staff), and there were <br /> two structures that were closer than 70 feet near Apple Mill, but the trail <br /> alignment used for the analysis in that area crosses the existing dam structure <br /> and is unlikely. In addition, these distances were measured to a point where <br /> the proposed alignment was on public right-of-way and not on OWASA land. <br /> There was one other structure at the end of Thunder Mountain Road that was <br /> under 100 feet, but the County's proposed trail alignment in that area is over <br /> 400 feet from the structure. The County did a separate GIS analysis and <br /> provided a summary of the results. Based on data they had on private <br /> residences they noted that the shortest distance from their proposed MST <br /> route on OWASA land to a dwelling unit was over 300 feet. <br /> 2. We should better define what we mean by protect neighbors'interests when it <br /> is not feasible to locate the trail at least fifty (50)feet within our property <br /> boundaries. Staff revised this condition to read "OWASA prefers that the trail <br /> 4.18 <br />
