1 <br /> 1 Attachment 3 <br /> 2 <br /> 3 DRAFT MINUTES <br /> 4 BOARD OF COMMISSIONERS <br /> 5 BUDGET WORK SESSION <br /> 6 May 9, 2017 <br /> 7 7:00 p.m. <br /> 8 <br /> 9 The Orange County Board of Commissioners met for a work session on Tuesday, May 9, 2017 <br /> 10 at 7:00 p.m. at the Southern Human Services Center in Chapel Hill, N.C. <br /> 11 <br /> 12 COUNTY COMMISSIONERS PRESENT: Chair Dorosin and Commissioners Mia Burroughs, <br /> 13 Mark Dorosin, Barry Jacobs, Earl McKee, Mark Marcoplos, Renee Price and Penny Rich <br /> 14 COUNTY COMMISSIONERS ABSENT: <br /> 15 COUNTY ATTORNEYS PRESENT: John Roberts <br /> 16 COUNTY STAFF PRESENT: County Manager Bonnie Hammersley, Deputy County Manager <br /> 17 Travis Myren and Clerk to the Board Donna Baker (All other staff members will be identified <br /> 18 appropriately below) <br /> 19 <br /> 20 Chair Dorosin called the meeting to order at 7:01 p.m. <br /> 21 <br /> 22 The Board, by consensus, decided to consider the Resolution Opposing A Proposal <br /> 23 Before the UNC Board of Governors to Prohibit Centers and Institutes From Participating in <br /> 24 Litigation. <br /> 25 Commissioner Rich read the resolution: <br /> 26 <br /> 27 ORANGE COUNTY BOARD OF COMMISSIONERS <br /> 28 <br /> 29 A RESOLUTION OPPOSING A PROPOSAL BEFORE THE <br /> 30 UNC BOARD OF GOVERNORS TO PROHIBIT CENTERS AND <br /> 31 INSTITUTES FROM PARTICIPATING IN LITIGATION <br /> 32 <br /> 33 WHEREAS, at its March 2, 2017 meeting, the Board of Governors of the University of North <br /> 34 Carolina received a proposed policy that "seeks to protect the academic focus of Centers and <br /> 35 Institutes by restricting Centers and Institutes from participating in litigation"; and <br /> 36 <br /> 37 WHEREAS, the proposed policy states that "no Center or Institute may...file a complaint, <br /> 38 motion, lawsuit or other legal claim in its own name or on behalf of any individual or entity <br /> 39 against any individual, entity, or government or otherwise act as legal counsel to any third party; <br /> 40 or employ or engage, directly or indirectly, any individual to serve as legal counsel or <br /> 41 representative to any party in any complaint, motion, lawsuit, or other legal claim against any <br /> 42 individual, entity, or government or to act as legal counsel to any third party"; and <br /> 43 <br /> 44 WHEREAS, practically speaking, the proposal would affect only the state's two public law <br /> 45 schools at the University of North Carolina at Chapel Hill and North Carolina Central University; <br /> 46 and <br /> 47 <br /> 48 WHEREAS, the ability of these centers and institutes to engage in litigation specifically against <br /> 49 state, city, and county governments serves as a proper check and balance in our country's <br />
