<br />A RESOLUTION AMENDING <br />THE JOINT PLANNING AREA ZONING ATLAS <br />WHEREAS, Orange County and the Town of Chapel Hill entered into a Joint <br />Planning Agreement, dated September 22, 1987, as amended April 2, 1990; and <br />WHEREAS, pursuant to the Joint Planning Agreement, a Joint Planning Area Land <br />Use Plan and Map were adopted on October 13, 1986, by all parties to the Joint <br />Planning Agreement, and have since been amended on several occasions; <br />WHEREAS, a Joint Planning Area hearing was held on October 15, 2003, in which a <br />rezoning of the adjacent subdivision to the north from Residential-1 to Residential <br />Special Standards Conditional was approved; <br />NOW THEREFORE, THE ORANGE COUNTY BOARD OF COMMISSIONERS AND <br />CHAPEL HILL TOWN COUNCIL HEREBY RESOLVE THAT THE .JOINT <br />PLANNING ZONING ATLAS BE AMENDED AS FOLLOWS: <br />That 10,431 square feet being on a portion of the site identified as now or <br />formerly Chapel Hill Township Tax Map 23, Block D, Lot 17 (PIN No. 9870- <br />53-6794) that is currently zoned Residential-1 (R-1 ), located adjacent to and <br />south of Lot 3 in the Rusch Hollow subdivision, shall be rezoned Residential- <br />Special Standards-Conditional (R-SS-C) zoning, with the following limitations <br />on use: No development may occur on this site unless the Town Council <br />amends the Special Use Permit authorizing the Rusch Hollow development to <br />include the rezoned portion, <br />The description of the area to be rezoned is indicated on the attached map. <br />NOW THEREFORE BE IT RESOLVED by the Board of Orange County <br />Commissioners that the Joint Planning Zoning Atlas is amended in accordance with <br />the above mentioned conditions and attached map. <br />upon motion of Commissioner ,seconded by Commissioner <br />the foregoing resolution was adopted this the day of , 2006, <br />I, Donna S, Baker, Clerk to the Board of Commissioners for the County of <br />Orange, North Carolina, DO HEREBY CERTIFY that the foregoing is a true copy of <br />so much of the proceedings of said Board at a meeting held on <br />2006 as relates in any way to the adoption of the foregoing and that said <br />proceedings are recorded in Minute Book No, of the minutes of said Board. <br />WITNESS my hand and the seal of said County, this day of <br />2006. <br />Clerk to the Board of Commissioners <br />
