18 <br /> 1 Craig Benedict said the fee must be paid by June 30, 2019 but the buildings must be <br /> 2 completed by December 31, 2020. He said Option 3 has an end date, while Option 2 is more <br /> 3 open ended. <br /> 4 Commissioner Burroughs asked if the County gets the money, why is a finish date <br /> 5 important. <br /> 6 Craig Benedict said staff tied the activity with the fees collected, and the student impacts <br /> 7 as close to when impacts within the schools would be expected. He said having it be in a <br /> 8 reasonable range, and a bit more finite, would create that connection between the fees paid <br /> 9 and the students coming. <br /> 10 Commissioner Rich said when discussing grandfathering, an example is given that goes <br /> 11 out to 2020, and asked if a project in 2018 would be grandfathered in as well. <br /> 12 Craig Benedict said these options only pertain to 2016-17 projects, and all future <br /> 13 projects would fall under the existing fee schedule. <br /> 14 Commissioner Rich clarified that the fees have been changed, and the grandfathering <br /> 15 will only apply to a few projects at this time, and moving forward all projects will fall under the <br /> 16 new fees. <br /> 17 Craig Benedict said yes. <br /> 18 Chair Dorosin referred to Option 3 with the 2020 limit, and asked if a project is not <br /> 19 completed, will the developer pay the current fee at that time. <br /> 20 Craig Benedict said yes. <br /> 21 Chair Dorosin said in 2020, it is likely that these fees will be under reassessment. He <br /> 22 asked if there is an opened ended approach taken, could a project potentially avoid the next <br /> 23 round of impact fees. <br /> 24 Craig Benedict said Chair Dorosin is correct. <br /> 25 Chair Dorosin asked if there is a projected timeline for reassessing impact fees in the <br /> 26 future. <br /> 27 Craig Benedict said this process will most likely occur in late 2021. <br /> 28 <br /> 29 PUBLIC COMMENT: <br /> 30 Aaron Nelson said a building permit expires after 12 months. He said Commissioner <br /> 31 Rich's question was their first proposal, and he said they are talking about five projects that are <br /> 32 eligible to be grandfathered in. He said they would like the Board to approve Option 2, and <br /> 33 lower the units from 100 to 90 units. He commended staff for their efforts. <br /> 34 Discussion ensued between the Board and Mr. Nelson. <br /> 35 Jacob Rogers is with the Triangle Apartment Association, and he thanked the Board for <br /> 36 allowing open dialogue. He said he is here to reiterate Mr. Nelson's comments, and is asking <br /> 37 for support for Option 2, with the units at 90 instead of 100 units. <br /> 38 Adam Golden, Vice President of Development with Northwood Ravin, echoed the <br /> 39 previous comments, and thanked the Board for hearing concerns and coming back with viable <br /> 40 options. He asked the Board to approve Option 2 with 90 units. <br /> 41 Commissioner McKee said it is difficult to anticipate all the variables involved with these <br /> 42 large projects, but he is reluctant to support an open-ended approach. He asked if there is a <br /> 43 definition for a more open-ended approach, wondering if it would mean 2020 or 2024. <br /> 44 Mr. Golden said the end of 2020 should cover most things in his project, but there are <br /> 45 always unexpected things, and thus it could go past 2020 for the final end of their project. <br /> 46 Chair Dorosin asked if Mr. Golden's project will be built in phases. <br /> 47 Adam Golden said yes. <br /> 48 Commissioner McKee said he is willing to reduce the number of units to 90, but is <br /> 49 uncertain about the lack of an end date. <br />
