17 <br /> 1 <br /> 2 Craig Benedict made the following PowerPoint presentation: <br /> 3 <br /> 4 2016 School Impact Fee Update- Technical Resolution Regarding Grandfathering of <br /> 5 Projects for School Impact Fee Collection Purposes <br /> 6 Item 7a <br /> 7 December 13, 2016 <br /> 8 Presenter: Craig Benedict, Planning Director <br /> 9 <br /> 10 Option 1- Proposed by Orange County Staff <br /> 11 Attachment 1 <br /> 12 <br /> 13 Option 2- Proposed by Northwood Ravin <br /> 14 Attachment 2 <br /> 15 <br /> 16 Option 3- Proposed by Orange County Staff <br /> 17 Attachment 3 <br /> 18 <br /> 19 RECOMMENDATION(S): <br /> 20 The Manager recommends that the Board: <br /> 21 • Discuss the grandfathering topic as desired. <br /> 22 • Adopt one of the attached resolutions as follows: <br /> 23 o Attachment 1 if the BOCC desires to adopt the proposal made by staff at the <br /> 24 December 5 BOCC meeting. <br /> 25 o Attachment 2 if the BOCC desires to adopt the additional language proposed by <br /> 26 Northwood Ravin for projects containing 100 or more dwelling units. <br /> 27 o Attachment 3 if the BOCC desires to adopt the additional language proposed by <br /> 28 Northwood Ravin for projects containing 100 or more dwelling units and place an <br /> 29 outer limit on issuance of a Certificate of Compliance of December 31, 2020. <br /> 30 <br /> 31 Commissioner McKee asked Craig Benedict if he could identify how many projects <br /> 32 would fall under this grandfather clause. <br /> 33 Craig Benedict said there are two: the Collins Ridge project in Hillsborough, and <br /> 34 Carraway Village in Chapel Hill. <br /> 35 Craig Benedict said the Special Use Permits (SUPs) in Chapel Hill focus more on <br /> 36 square footage as opposed to units. <br /> 37 Commissioner McKee asked if the Collins Ridge project with 1,000 units would qualify <br /> 38 with Option 3. <br /> 39 Craig Benedict said no, as there are still deadlines to have a zoning compliance permit <br /> 40 prior to January 1, 2017. He said this project is in the process of a zoning compliance permit <br /> 41 on one of the phases. He said there is more work to do, and the project may fall out of the <br /> 42 running. <br /> 43 Commissioner McKee asked if, given all the restrictions, would any units qualify. <br /> 44 Craig Benedict said that is difficult to say. <br /> 45 Commissioner Burroughs asked if the differences between the Option 2 and 3 are the <br /> 46 ending dates. <br /> 47 Craig Benedict said in Option 1, the zoning compliance permit has to be completed by <br /> 48 June 30, 2019; and in Option 2, the zoning compliance permit may not be completed but the <br /> 49 fee can be paid by June 30, 2019. <br /> 50 Commissioner Burroughs asked for clarification between Options 2 and 3. <br />
