2 <br /> the contract with the selected contractor as the owner of the project. The County will also <br /> approve any change orders that affect the cost of the project. <br /> As part of bidding process, OWASA uses a prequalification policy to insure that contractors who <br /> bid on the project are qualified to construct a project of this scope and complexity. The policy <br /> also includes an appeal process for contractors that are initially screened out as part of the <br /> prequalification evaluation. State law requires that jurisdictions that use a prequalification <br /> process adopt a policy on how that process will be administered. Since OWASA is performing <br /> the prequalification process on behalf of the County, this abstract recommends that the County <br /> approve OWASA's existing policy. <br /> FINANCIAL IMPACT: The Interlocal Agreement provides that the cost of bidding and <br /> construction administration services shall not exceed $553,000 unless approved by the County. <br /> The Adopted FY2016-17 Capital Investment Plan contains sufficient funding for these services <br /> as well as the estimated construction costs. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goals are applicable <br /> to this agenda item: <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, incomes <br /> and educational levels with respect to the development and enforcement of <br /> environmental laws, regulations, policies, and decisions. Fair treatment means that no <br /> group of people should bear a disproportionate share of the negative environmental <br /> consequences resulting from industrial, governmental and commercial operations or <br /> policies. <br /> • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY <br /> The creation and preservation of infrastructure, policies, programs and funding necessary <br /> for residents to provide shelter, food, clothing and medical care for themselves and their <br /> dependents. <br /> RECOMMENDATION(S): The Manager recommends that the Board: <br /> 1) Approve and authorize the Chair to execute an Interlocal agreement between Orange <br /> County and Orange Water and Sewer Authority (OWASA) in an amount not to exceed <br /> $553,000 for the construction phase of the Rogers Road Sewer Extension Project, and <br /> 2) Approve the prequalification policy included as Attachment 2 that OWASA will use to <br /> prequalify contractors. <br />
