The decision whether to prequalify the bidder that requested the appeal shall be <br /> communicated in writing to the bidder and said decision shall be final. The final ruling <br /> shall be made within 30 business days of OWASA's receipt of the bidder's written <br /> appeal. <br /> SECTION D. BIDS SUBMITTED BY NONPREQUALIFIED BIDDERS ARE <br /> NONRESPONSIVE <br /> D.1. Whenever OWASA opts to prequalify bidders, any bids submitted by a bidder not <br /> prequalified shall be deemed nonresponsive and shall be rejected. <br /> D.2. This section of this policy does not apply to bidders initially denied qualification that are <br /> subsequently prequalified pursuant to Section C above. <br /> SECTION E. PREQUALIFICATION NOT APPLICABLE TO QUALIFICATION- <br /> BASED SERVICES <br /> E.1. Prequalification shall not be used for the selection of any qualification-based services as <br /> referenced in G.S. 143-135.8.(e). <br />
