15 <br /> Orange Water and Sewer Authority <br /> Bidder Prequalification Policy <br /> Page 2 <br /> a. Organizational Structure — The bidder shall provide pertinent information about its <br /> organization structure (e.g. legal name, address, phone number, responsible persons' <br /> names and titles, etc.). <br /> b. Classification — The bidder shall provide licensure, and other pertinent information, <br /> including its Historically Underutilized Business (HUB) status. <br /> c. Experience—The bidder shall furnish documentation of its ability to perform the work <br /> for the type of project for which prequalification is being requested. <br /> d. Financial — The bidder shall provide, at a minimum, a complete current annual <br /> financial statement (current within the previous 12-month period). <br /> e. Litigation/Claims—The bidder shall provide information on its success at completing <br /> projects on time, including the payment of liquidated damages. The firm will be <br /> required to submit information regarding its litigation history, including litigation with <br /> owners. <br /> f. Capacity—The bidder shall demonstrate sufficient bonding capacity, insurance and <br /> resources for the project. It shall provide relevant infoimation on the personnel <br /> that will be directly responsible for the work, including the location of the office that <br /> will be primarily responsible for work. The bidder shall demonstrate an acceptable <br /> safety history(as defined by OWASA) for construction projects. <br /> g. Legal Authorization — The bidder shall provide documentation that they are legally <br /> authorized to conduct business in the State of North Carolina and have all required <br /> licensure for the work to be performed. <br /> SECTION C. BIDDER PREQUALIFICATON DENIAL APPEAL PROCESS <br /> C.1. In the event that a bidder is denied prequalification, OWASA shall communicate the <br /> basis for the denial in writing to the bidder denied prequalification. <br /> C.2. Bidders shall have a right to appeal prequalification denial. If a denied bidder so <br /> chooses, following receipt of the written prequalification denial, the bidder shall submit a <br /> request to appeal the denial within three (3) business days of receipt of notification, <br /> which shall be not later than five (5) business days after the date of mailing of the notice <br /> of denial. The bidder's written appeal shall be addressed, and delivered, to the OWASA <br /> project manager in charge of the subject project within the time allowed. The written <br /> appeal shall clearly articulate the reasons why the bidder is contesting the denial and <br /> include all documents and additional supporting information. <br /> C.3. The OWASA project manager shall provide the request for appeal to OWASA's <br /> Executive Director, or to his/her designee, for review and ruling. <br /> C.4. The reviewer shall attempt to contact the bidder that requested an appeal and discuss the <br /> basis of the denial in person or by telephone prior to deciding whether to uphold or <br /> overrule the denial. Additional information may be requested from the bidder prior to a <br /> ruling on the denial being made. If warranted, the reviewer may consult OWASA's <br /> General Counsel for guidance in making a ruling. <br />
