Attachment 2 13 <br /> i RESOLUTION ADOPTING A POLICY TO <br /> I ! PREQUALIFY BIDDERS FOR CONSTRUCTION OR REPAIR WORK <br /> WHEREAS, the State of North Carolina passed legislation that was signed into law by the <br /> Governor of the State of North Carolina on June 30,2014; and <br /> WHEREAS, the new law, S.L. 2014-42 (BB 1043), amends G.S. 143-135.8 by establishing <br /> specific procedural requirements for when and how local governments may prequalify construction <br /> contractors to bid on construction or repair contracts;and <br /> WHEREAS,the focus of these new requirements is to ensure that a prequalification process is <br /> conducted transparently using criteria that relate to the specific project being bid and which are applied <br /> objectively and fairly to all bidders;and <br /> WHEREAS, the new requirements require that the prequalification process be followed in <br /> accordance with a uniform Board-adopted policy equally applicable to all candidates, and specifically <br /> require that bidders denied prequalification have an opportunity to learn why they were denied <br /> prequalification and to appeal that denial;and <br /> WHEREAS,the changes to G.S. 143-135.8 went into effect on October 1,2014, and apply to all <br /> contracts awarded on or after that date; and <br /> WHEREAS, Orange Water and Sewer Authority may desire to prequalify bidders for specific <br /> construction or repair contracts; <br /> NOW,THEREFORE,BE IT RESOLVED: <br /> 1. The Board of Directors of Orange Water and Sewer Authority approve the attached <br /> Bidder Prequalification Policy. <br /> 2. That the policy complies with all conditions and requirements of the attached G.S. 143- <br /> 135.8 as amended by S.L.2014-42(11B 1043)effective October 1,2014. <br /> 3.
