1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: November 15, 2016 <br /> Action Agenda <br /> Item No. 6-e <br /> SUBJECT: Unified Animal Control Ordinance Amendments <br /> DEPARTMENT: Animal Services and County <br /> Attorney <br /> ATTACHMENT(S): INFORMATION CONTACT: <br /> 1) Strikethrough-Underline Version of Bob Marotto, Animal Services Director, <br /> Animal Control Ordinance 919.968.2287 <br /> 2) Resolution of Amendment Annette Moore, Staff Attorney, 919. <br /> 245.2317 <br /> PURPOSE: To consider approval of the proposed Unified Animal Control Ordinance ("UAO") <br /> amendments and adoption of the Resolution of Amendment Amending Chapter 4 of the Orange <br /> County Code of Ordinances. <br /> BACKGROUND: At its January 26, 2016 meeting, the Board of County Commissioners <br /> ("BOCC") adopted the UAO. Since the adoption staff has determined two items need <br /> amendment: <br /> 1. A sentence was inadvertently omitted from Section 4-45(b) Public Nuisance. That <br /> sentence is "The animal is found at large." Adding this sentence enacts a public <br /> nuisance provision that was in effect prior to adoption of the UAO. <br /> 2. The Animal Services Advisory Board has determined that the word "vicious," found <br /> throughout the ordinance, is leading to some determinations being appealed, not <br /> based on the facts of the determination, but based on dislike of the word "vicious". In <br /> order to avoid this situation in the future, the Animal Services Advisory Board <br /> recommends the word vicious be changed to dangerous. That amendment is made <br /> throughout the attached document. <br /> FINANCIAL IMPACT: There is no financial impact associated with the adoption of the <br /> proposed unified animal control ordinance. <br /> SOCIAL JUSTICE IMPACT: There is no social justice impact associated with this item. <br /> RECOMMENDATION(S): The Manager recommends the Board adopt the proposed Unified <br /> Animal Control Ordinance amendments and approve and authorize the Chair to sign the <br /> Resolution of Amendment, "A Resolution Amending Chapter 4 of the Orange County Code of <br /> Ordinances". <br />
