Partial Width Right-of-Way <br /> (1) Bennie Bradsher <br /> Presentation by Eddie Kirk. <br /> The proposed minor subdivision is located on the <br /> south side of Gibbs Lane (SR 1564) off Palmers <br /> Grove Road (SR 1562) . The applicant is <br /> requesting to divide a 4.41 acre lot. The lot <br /> frontage on Gibbs Lane is 353 feet and the <br /> property is zoned R-1 . A Class C private road <br /> about 400' in length is proposed along the <br /> western boundary of the property. Both lots <br /> would be served by wells and septic tanks. An <br /> existing house is located on the southern portion <br /> of the property. <br /> Reduction of the right-of-way from 50 feet to 25 <br /> feet is needed to exclude a line of existing <br /> trees from the private road right-of-way. An <br /> existing drive extends along the property line <br /> between Mr. Bradsher' s property and the property <br /> to the west owned by Fred Albert. Mr. Albert has <br /> indicated that when he is ready to divide his <br /> property he will provide the additional 25 feet <br /> required to meet the 50 foot right-of-way <br /> requirement. This right-of-way would then extend <br /> to the southern property line of Mr. Bradsher's <br /> and Mr. Albert' s property. <br /> Planning Staff recommends approval of a partial <br /> width right-of-way of 25 feet for the B.E. <br /> Bradsher, Jr. property. <br /> Best expressed the concern that if Mr. Albert is <br /> willing to provide the additional 25 feet at a <br /> later time, why can't it be done now and avoid <br /> the need for a partial width right-of-way.
