CO 19 <br /> D1aCI <br /> The Orange County Erosion Control Officer has <br /> indicated the subdivision meets the stormwater <br /> management requirements. An erosion control <br /> plan must be submitted and approved before <br /> construction of the road begins. A 30 ' drainage <br /> easement will also be needed through lots 11-14 <br /> and possibly lot 15 for runoff purposes. <br /> The County Engineer indicated he has no comment <br /> on the Preliminary Plan. <br /> The Planning Staff recommends that the <br /> Preliminary Plan for Buck Run be approved <br /> through the Resolution of Approval (an attachment <br /> to these minutes on pages . ) <br /> Best asked what legal ground NCDOT has to require <br /> that the cul-de-sac be located within the <br /> subdivision. Yuhasz responded that because of <br /> the way the end of the cul-de-sac is drawn, NCDOT <br /> may not have thought the property under the <br /> right-of-way was going to be public. If the <br /> dashed line was indicated as a solid line then <br /> the right-of-way would be a part of the <br /> subdivision and that should satisfy NCDOT <br /> requirements. <br /> Best continued that if the stubout is moved to <br /> the end of the property line then the two <br /> property owners now don't have to worry about <br /> --- 1/10 of their property being under pavement when <br /> the road is extended. <br /> Mr. Daniels, the developer, stated that he had <br /> discussed this item with NCDOT and they indicated <br /> since it was going to be a private road in the <br /> back, the cul-de-sac had to be within the <br /> subdivision. Yuhasz responded that the property <br /> line could be drawn so that the cul-de-sac was <br /> within the development no matter where the cul- <br /> de-sac is located. <br /> Eddleman state that the way item B4 in the <br /> resolution is written, it is appropriate no <br /> matter where the cul-de-sac is located. <br /> MOTION: Best moved approval as recommended by the <br /> Planning Staff. Seconded by Eddleman. <br /> VOTE: 9 in favor. <br /> (Abrams & Lewis left at 9 :00 p.m. prior to this <br /> vote. Cantrell arrived at 9 :00 and did not <br /> vote. ) <br />
