• <br /> C <br /> l' <br /> PROPOSAL FOR PERSONNEL ORDINANCE REVISION <br /> TO ADOPT A SEXUAL HARASSMENT POLICY <br /> (This Proposal Requires Adoption by the County Commissioners) <br /> 1 PURPOSE <br /> The purpose of this policy is to provide guidelines, and to <br /> 1 establish that Orange County prohibits all forms of sexual <br /> harassment of applicants, employees, and citizens conducting <br /> business with county government employees. <br /> 1 POLICY <br /> I The policy of Orange County is that no employee may engage in <br /> conduct that falls under the definition of sexual harassment. <br /> The definition of sexual harassment is any unwelcome sexual <br /> I advances , requests for sexual favors and other verbal or <br /> physical conduct of a sexual nature when 1 ) submission to <br /> such conduct is made either explicitly or implicitly a term <br /> or condition of an individual ' s employment; 2 ) submission to <br /> I or rejection of such conduct by an individual is used as the <br /> basis for employment decisions; or 3 ) such conduct has the <br /> effect of unreasonably interfering with the individuals <br /> I ability to perform work, and/or creates an intimidating, <br /> hostile or offensive work environment. <br /> 1 Sexual harassment does not include conduct welcomed by the <br /> recipient, or social interactions and relationships entered <br /> into freely by County applicants, employees or citizens. <br /> 1 COMPLAINT PROCEDURE <br /> . <br /> Every employee is entitled to work in an environment free of <br /> 1 sexual harassment . Any employee, applicant or client who <br /> feels he/she has been sexually harassed may file a complaint <br /> using the following procedure. <br /> I1) Report the alleged misconduct to your immediate <br /> supervisor, if he/she is not involved in the <br /> complaint, or <br /> 2) Report the alleged misconduct to the Department Head, <br /> if he/she is not involved in the complaint, or <br /> I3 ) Report the alleged misconduct directly to the EEO <br /> Officer (Karen Boulding) in the Personnel Department <br /> I. of Orange County. <br /> Prompt and impartial investigation will be made of all cases <br /> I alleging sexual harassment based on facts presented <br /> surrounding the misconduct. All information received <br /> regarding the alleged incidents of sexual harassment will be <br /> treated with privacy and confidentiality. Any interference, <br /> coercion, restraint or reprisals towards any person <br /> complaining of sexual harassment is prohibited. <br /> I 2 <br />
