2 <br /> 5 <br /> To implement the density bonus provisions, a new Article <br /> 7. 14.4 is proposed to be added to the Zoning Ordinance. <br /> 7.14.4 Affordable Housing <br /> 7 . 14.4 1 -An increase in density may be permitted for Planned <br /> Developments which provide on-site or off-site <br /> housing opportunities for low or moderate income <br /> households. A contract shall be approved by the <br /> County Attorney and the Department of Housing and <br /> Community Development as a condition of permit <br /> approval guaranteeing that the reserved units will <br /> be occupied purchased by or rented to qualifying <br /> households, and shall be binding for a period of <br /> not less than 15 years. <br /> Applicability <br /> 1. A density bonus may not be approved for a <br /> Planned Development project located on land <br /> designated in the Comprehensive Plan as a <br /> Water Supply Watershed, except land that is <br /> also designated as Transition Area._ <br /> 2 . A 25% density bonus for duplex or multi- <br /> family units may be approved if: <br /> a. A minimum of 40% of the units are to be <br /> rented occupied to families earning <br /> less than 60% of the median area income <br /> adjusted for family size, <br /> OR <br /> b. A minimum of 20% of the units are to be <br /> rented occupied to families earning <br /> less than 50% of the median area income <br /> adjusted for family size. <br /> 3. A 25% density bonus for single-family <br /> residential development may be approved if <br /> the greater of two (2) units or all of the <br /> bonus units are to be sold to families <br /> earning less than 80% of regional median <br /> income . <br /> 4. A 25% density bonus for single-family <br /> residential development may be approved if <br /> land with suitable soils or access to public <br /> water and sewer is donated to Orange County <br /> for the purpose of the development of <br /> affordable housing.
