DUTTON of Adjustment procedures I noticed references in both <br /> REX T.SAVERY,JR. to the meetings of the Board of Adjustment being open <br /> Or Counsel to the public. A more accurate statement should be <br /> BON`ERR D.ISSA YER that the meetings are subject to the Open Meetings Law <br /> with a citation to the Open Meetings Law. There is at <br /> least one other typographical error in Section 2.3.3.2 <br /> of the Zoning Ordinance. <br /> I recommend that Section 2.3.3.2 be rewritten as <br /> follows with a corresponding change to the Board of <br /> Adjustment Procedures: <br /> 2.3.3.2 All meetings of the Board shall be <br /> conducted in compliance with the North <br /> Carolina Open Meetings Law, North <br /> Carolina General Statutes §143--319.9 <br /> et seq. The Board shall give public <br /> notice of its meetings also as <br /> provided in the Open Meetings Law. <br /> Notice shall be given to Board of <br /> • Adjustment members as provided in the <br /> Rules of Procedure adopted by the <br /> Board. <br /> This change will make it clear that the Board of <br /> Adjustment can go into executive session for <br /> appropriate purposes. Enclosed is a copy of the <br /> pertinent provisions of the Open Meetings Law for your <br /> • information.
