He noted that <br /> staff had recognized this as a rapidly <br /> suburbanizing area even with the Rural Buffer <br /> behind it. Whether or not this would remain a <br /> rural area becomes a judgment call which is part <br /> of the reason for using concept plans . <br /> Eddleman asked if this tract was a part of the <br /> original tract participating in the Road <br /> Maintenance Agreement. Mr. Carroll responded no. <br /> He continued that he felt requiring a public road <br /> in such an instance with no possibility of being <br /> connected to another road would only increase the <br /> cost of the lots . <br /> Best noted that NCDOT could be petitioned for <br /> state maintenance and the individual lot owners <br /> would not have to pay for maintenance of a <br /> private road. Mr. Carroll indicated he felt the <br /> cost of a public road would exceed the cost of <br /> maintenance of a private road. Best indicated <br /> that the cost over the life span of the property <br /> would be considerably less for a public road. <br /> Jacobs noted that based on discussions with the <br /> County Attorney and the Planning Board that the <br /> presumption is that above a certain threshold all <br /> of the roads in Orange County are to be public <br /> unless a sufficient case is made for a private <br /> road. Mr. Carroll asked what the threshold is . <br /> Jacobs responded that NCDOT will not accept a <br /> road for maintenance with less than four (4 ) <br /> lots . <br /> c.
