C. 27279 <br /> Attention: Mosey Carey <br /> Re: C< Properties 4 Ac tract -- appeal of private road justification <br /> Gentlemen: <br /> By virtue of this letter, we are hereby appealing the rejection of <br /> the private road justification for the above referenced property. <br /> The reason for this appeal is to preserve the rural character of this <br /> property and to protect over 100 healthy trees that would have to be <br /> removed to change this existing private road now serving 4 lots, to a <br /> public road and serving a maximum of seven lots. <br /> RESTATEMENT AND DOCUMENTATION OF JUSTIFICATION <br /> OF LEAVING ROY ROAD A PRIVATE ROAD <br /> 1 . Roy Road is a existing private road only 520' long and <br /> approximately 20' from ditch to ditch. The road bed sits on <br /> the east side of the right of way line. This was done to <br /> avoid removing three large stands of hardwoods. (see <br /> attached plat and photos. ) Not only the trees counted and <br /> shown in the- photographs have to be removed, but because of <br /> the slope on the west side of the right of way, additional <br /> trees will have to be removed• from the existing lots to allow <br /> for proper slope on the shoulder to meet DOT regulations for <br /> public road standards. <br /> Roy Road already has a recorded road maintenance agreement <br /> and the agreement allows for the addition of the three new <br /> lots requested; without changing this agreement. No further <br /> dividing can be done to any of the lots fronting Roy Road. <br /> • <br />
