2 <br /> Subsequent to Planning Board review, additional <br /> information was submitted by the applicants (see <br /> attachments) regarding the location of the existing <br /> private road and the number of trees which would be <br /> removed to upgrade Roy Road to the standards of NCDOT. <br /> The new information provided does not alter the <br /> Planning Staff's evaluation of the private road <br /> justification which compares the proposed private road <br /> with the ordinance requirements of Section IV-B-3-d-1 . <br /> Criteria for justification of a private road as <br /> specified in the Subdivision Regulations have not <br /> changed during the last year. The criteria include: <br /> 1 . Preservation of rural character through <br /> a. Larger lots and larger setbacks than the <br /> minimum required; <br /> b. Maintaining a wooded character and screening <br /> the subdivision from the public road; <br /> c. Maintaining scenic views; and/or <br /> d. Clustering to preserve significant . areas. <br /> 2 . Unacceptable for State maintenance due to <br /> density or other State requirements . <br /> 3 . Prohibition of further subdivision of the lots . <br /> 4. Preservation of more recreation/open space than <br /> required. <br /> 5. Larger stream buffers or other design features <br /> to prevent pollution of water supply reservoirs . <br /> Reducing the number of trees to be removed for road <br /> construction is not one of the criteria in the <br /> ordinance. Item 1 .b. above does not apply since the <br /> character of the subdivision is almost entirely open <br /> field, with the exception of trees along Dairyland <br /> Road. The trees which the applicant would like to <br /> preserve are located in the right-of-way for Roy Road, <br /> and not on the lots in the proposed subdivision. <br /> With regard to the location of the existing private <br /> road and the removal of "in excess of 100 trees, " the <br /> applicants could take an alternative approach. By <br /> dedicating sixteen ( 16) feet of additional right-of- <br /> way on the eastern side of Roy Road, fifty (feet) of <br /> clearance could be provided as required by DOT while <br /> only removing 44 trees (including trees with only a <br /> 4"-6" caliper) . <br /> RECOMMENDATION: The Administration recommends approval of the concept <br /> plan for CK Properties with a public road built to <br /> State standards. <br />
