mmmm <br /> 12 <br /> public hearing regulations to require that <br /> once opened, any public hearing remain open <br /> until a final decision is made by the Board <br /> of County Commissioners. <br /> The testimony received at a public hearing is <br /> on record as information considered by the <br /> hearing body in rendering its decision. <br /> Testimony received outside of the public <br /> hearing may not be considered. <br /> The purpose of the proposed amendment is to <br /> assure that all information received prior to <br /> the decision of the Board of County <br /> Commissioners can be considered.ed. Ifaappr red <br /> the amendment would deem a public <br /> open, from the initial hearing date until the <br /> time of final decision. <br /> The Board of Commissioners expressed concern <br /> with allowing verbal testimony to be <br /> introduced at the Planning Board meeting., <br /> Additional opportunities for verbal comments <br /> could result in repetition of comments made <br /> at the public hearing, and would be a <br /> disincentive for attending the Joint Board of <br /> Commissioners/Planning Board public hearing. <br /> New information or other comments should only <br /> be accepted in writing and used by the <br /> Planning Board in making a recommendation and <br /> by the Board of Commissioners in making the <br /> final decision. <br /> Similar comments were offered by the Town of <br /> Carrboro through the courtesy review <br /> procedure established in the Joint Planning <br /> Agreement. <br /> The Planning Staff recommends approval of the <br /> proposed amendment, with changes to allow the <br /> introduction of written testimony only after <br /> the initial date of the public hearing. <br /> MOTION: Jacobs moved approval with the public hearing <br /> to remain open for written comment through <br /> the Planning Board meeting. Seconded by <br /> Eddleman. <br /> Yuhasz stated he felt this would be <br /> appropriate and the Planning Board would have <br /> all the information prior to making its <br /> recommendation to the Board of Commissioners. <br /> Best indicated he did not understand the <br /> r <br />
