PROPOSED ORDINANCE AMENDMENT <br /> ORDINANCE: ZONING ORDINANCE <br /> SUBDIVISION REGULATIONS <br /> REFERENCE: ARTICLE 20.7 ACTION SUBSEQUENT TO THE DATE OF <br /> PUBLIC HEARING <br /> ORIGIN OF AMENDMENT: Staff Planning Board <br /> BOCC Public <br /> x Other: County Attorney <br /> STAFF PRIORITY RECOMMENDATION: x High Middle Low <br /> Comment: <br /> PUBLIC HEARING DATE: August 28, 1989 <br /> PURPOSE OF AMENDMENT: <br /> To establish guidelines by which information received after <br /> the advertised date of a public hearing may be considered by <br /> the Planning Board and Board of Commissioners. <br /> IMPACTS/ISSUES: <br /> Evidence received at a public hearing becomes part of the <br /> public record and is considered by the hearing body in <br /> rendering its decision. Evidence received outside of the <br /> public hearing may not be considered. Unless a hearing is <br /> specifically held open by the Board of Commissioners, new <br /> information submitted by staff, other departments or <br /> agencies, or the public cannot be considered without <br /> readvertising, and conducting an additional hearing. <br /> The proposed amendment would allow for new information to be <br /> considered as follows: <br /> 1. New information must be presented in writing, and made <br /> available to the Planning Board prior to its <br /> recommendation to the Board of Commissioners. <br /> 2. Verbal presentations to the Planning Board may be <br /> limited to a summary or explanation of material <br /> previously submitted in writing. <br /> 3. The Board of Commissioners will receive all written <br /> comments prior to making its decision, and may hear <br /> presentations made in explanation of those comments. <br /> 4. Information which was not available to the Planning <br /> Board when its recommendation was made may not be <br /> considered by the Board of Commissioners in making its <br />
