• <br /> The proposal presented for public hearing on August 22 4 <br /> specified only that the public hearing would remain open <br /> between the advertised public hearing and the final decision <br /> by the Board of Commissioners. The revisions address <br /> concerns with a lack of restriction as to when and how <br /> information would be received during that period. The <br /> revisions assure that both the recommendation of the Planning <br /> Board and the decision of the Board of Commissioners will be <br /> based on the same information, while allowing for additional <br /> relevant information to be incorporated into the process. <br /> EXISTING AND PROPOSED ORDINANCE PROVISIONS: <br /> SUBDIVISION REGULATIONS: <br /> VII-D-4 Action Subsequent to the Date of Public Hearing <br /> Following the date of the public hearing, all <br /> proposed amendments shall be referred to the <br /> Planning Board for its consideration and <br /> recommendation. Evidence not presented at the <br /> joint public hearing (hereinafter called "new <br /> evidence" ). may be submitted in writing at or prior <br /> to the Planning Board meeting at which the <br /> recommendation to the Board of Commissioners is <br /> made. _'he Planning Board may consider oral <br /> evidence only if it is for the purpose 21 <br /> presentina information also submitted in writing._ <br /> The recommendation. of the Planning Board will be <br /> forwarded to the Board of Commissioners. In <br /> making its decision, the Board 21 Commissioners <br /> shall consider all relevant evidence presented at <br /> the joint public hearing, and any new evidence <br /> which was considered by the Planning Board in <br /> making its recommendation. <br /> The Planning Board shall submit its <br /> recommendations, including the reasons for its <br /> determination, to the Board of Commissioners within <br /> seventy-five (75) days after such amendments have <br /> been referred to the Planning Board.
