DMUU U 14 <br /> The focus of all of the changes has been to <br /> narrow the applicability of the ordinance to <br /> 10 focus in on large, physically impacting projects . <br /> c. Zoning Ordinance Text Amendments <br /> (1) Article 2 . 3 . 3 .2 - Board of Adjustment <br /> Administration <br /> Presentation by Eddie Kirk. <br /> This agenda item is to receive information on a <br /> proposed amendment to the Zoning Ordinance to <br /> reference that the Board of Adjustment meeting is <br /> subject to the Open Meetings Law. <br /> The proposed amendment provides a reference to <br /> the portion of the General Statutes pertaining to <br /> Open Meeting Laws (G.S. 143-318.9 et seq) . This <br /> portion of the General Statutes includes the <br /> purposes for which a public body may hold an <br /> executive session and exclude the public. <br /> A copy of the section of the Open Meeting Laws <br /> pertaining to executive sessions (G.S. <br /> 143.318.11) , is an attachment to these minutes on <br /> page . <br /> The Planning Staff recommends that the proposed <br /> amendment be advertised for public hearing on <br /> February 26, 1990. <br /> MOTION: Best moved to accept the Planning Staff's <br /> recommendation. Seconded by Abrams. <br /> VOTE: 8 in favor (Yuhasz, Jacobs, Burklin out of the <br /> during this vote) . <br /> (2) Article 7. 14.4 - Density Bonus for <br /> Affordable Housing <br /> Presentation by Mary Scearbo. <br /> This amendment was first introduced at the public <br /> hearing on August 28, 1989. The Planning Board <br /> considered the amendment on October 16, 1989, and <br /> recommended approval. Before the amendment was <br /> presented to the Board of Commissioners for a <br /> final decision, questions arose as to how the <br /> bonus provisions would apply if family income <br /> increased after a reserve unit was purchased or <br /> rented,, or if a home appreciated to a non- <br /> affordable level and the owners wanted to sell. <br /> r <br />
