17 <br /> contain at a minimum the land area needed to <br /> develop of the greater of two (2) units or <br /> the total number of the bonus units, in <br /> accordance with the zoning requirements of <br /> the district in which the donated land is <br /> located, or with minimum lot size of 40, 000 <br /> square feet in unzoned areas. <br /> 5 . A 50% density bonus may be approved if at <br /> least 20% of the units are to be occupied by <br /> low income families (earning < 50% of median <br /> area income) and the remaining 80% of units <br /> are occupied by moderate income families <br /> ( <80% of median area income) . This bonus <br /> shall not apply to lands which have been <br /> donated to Orange County in exchange for a <br /> density bonus pursuant to (3 . ) above. <br /> 6 . Median Income shall be consistent with that <br /> used for Orange County by the U. S. <br /> Department of Housina and Urban Development <br /> Findings <br /> The following findings shall be made in support <br /> of the density increase: <br /> 1. The social benefit to be derived from the <br /> increase in the amount of affordable housing <br /> justifies the increase in permitted lots or <br /> units . <br /> 2 . The location of the affordable units does <br /> not represent an undue concentration of low- <br /> income housing. <br /> 7 . 14 .4.2 The contractual agreement with Orange County shall <br /> be administered by the Orange County Department of <br /> Housing and Community Development, (HCD1 and shall <br /> include the following provisions: <br /> 1 . All sales and rental transactions shall be <br /> a roved b HCD to assure com liance wit <br /> eligibility criteria. <br /> 2 . Appreciation of the property shall be limited <br /> to assure that the units remain affordable in <br /> the event of sale during the 15- year term of <br /> the contract. <br /> 4. Home ownership counseling shall be provide hy <br /> HCD to all new homeowners. <br />
