Provided, however, private roads may be allowed in a <br /> subdivision where, in the judgment of the Planning Board <br /> 10 <br /> and with the approval of the Board of County <br /> Commissioners, it is found that the nature and location <br /> of the subdivision are such that a private road is <br /> justified. <br /> (The road is located in an area that is experiencing <br /> some residential development. The 4 lots proposed to be <br /> served are larger residential lots. Its location, in <br /> University Lake Watershed, is in an area where a private <br /> road would reduce the amount of impervious surface and <br /> allow more infiltration of stormwater. ) <br /> In determining whether to permit private roads in <br /> subdivisions, the , following design features will be <br /> considered: <br /> 1 . The location and design of the subdivision is such <br /> that it clearly preserves the rural character of <br /> the County •through : <br /> a. The provision of lot sizes and building <br /> setback lines greater than required by <br /> ordinance provisions; <br /> Lot sizes proposed on the concept plan are greater <br /> than five acres as required by the interim <br /> development standards except lot #10. The average <br /> • lot size is 5. 38 acres. Setbacks are not indicated <br /> on the plan. <br /> b. The retention and/or provision of landscaping <br /> and use of clustering of dwelling units to <br /> screen the view of the subdivision from public <br /> roads and/or maintain a wooded or forested <br /> character; <br /> (The area north of Dairyland Road is wooded. The <br /> . private road justification indicates there will be <br /> a natural visual barrier between the proposed homes <br /> and Dairyland Road. Provisions for tree protection <br /> should be included in restrictive covenants. ) <br /> c. The 'maintenance of scenic views, including <br /> • vistas of open farmland and/or forested hills <br /> and mountains; and/or <br /> (The applicant indicates the design ensures <br /> preservation of the rural character in the area. <br /> Provisions for tr e.e protection should be included <br /> to insure this. ) <br /> d. The clustering of dwelling units to presorva <br /> •wildlife, botanical, historic, archaeological <br /> and/or recreation sites; <br /> (Clustering of dwelling units is not proposed. ) <br />
