Scearbo responded <br /> because the legal right-of-way is still required <br /> to be 50' and a Road Maintenance Agreement is <br /> also required. <br /> Yuhasz stated that he would like Staff to <br /> " consider a flag lot as an option rather than the <br /> additional complication of a Road Maintenance <br /> Agreement and road signs. <br /> After discussion between Best and Yuhasz <br /> regarding driveways onto the Class C private <br /> road, Yuhasz noted that a condition could be <br /> added to that both driveways access the private <br /> road near the lot line. <br /> MOTION: Yuhasz moved approval of the partial width right- <br /> of-way and suggested that Staff review the <br /> request and if a flag lot is appropriate, that <br /> the owner be notified of that alternative. <br /> Seconded by Lewis. <br /> Jacobs noted the discussion from the December 18, <br /> 1989 minutes between Collins and Yuhasz that <br /> listed those situations in which flag lots are <br /> appropriate.
