Part II - Discretionary Funding Request 14 <br /> On December 5, 1989, I forwarded to Mr. Link the School Board adopted <br /> CIP for the 1991-95 five-year period. Included with that request was a request <br /> for "County Discretionary Funds" (dated 12/4/89) in the amount of. $200,000. <br /> The request was based on the need for complying with a series of environmental <br /> protection issues; including underground fuel storage tanks, lead in the water, <br /> radon and asbestos. Subsequently, Mr. Link recommended that $ 150,000 be <br /> approved from the "Discretionary" account. <br /> The letter of inquiry first, asked for information in this area on the <br /> EPA regulations that call for this action. I will respond by category. <br /> 1) Asbestos: We are operating under two sets of regulations. <br /> The first set is based on federal law (AHERA) signed by <br /> President Reagan on October 22, I986, for which EPA issued <br /> final rules in the Federal Register on October 30, 1987. <br /> The second set of requirements came from North Carolina <br /> law, specifically N.C. House Bill 516 (Chapter 724) rati- <br /> fied on August 3, 1989, with an effective date of <br /> November 1 , 1989. The North Carolina requirements are <br /> further outlined in the N. C. Administrative Code - <br /> NCAE 7C.0601-.0602, Section .0600 - Asbestos Hazard <br /> Management Programs. <br /> 2) Underground Storage Tanks: This area is addressed in <br /> technical standards of EPA in 40 CFR280, which became <br /> effective December 22, 1988. Also applicable in this <br /> area is N. C. G.S. 143-215.75. <br /> 3) Lead in the Water: Lead in drinking water is covered in <br /> U. S. Public Law 100-572 entitled Lead Contamination <br /> Control Act of October 31 , 1988. EPA issued a guidance <br /> document and testing protocol. <br /> 4) Radon: EPA recommended that testing for radon be con- <br /> ducted in all schools and issued a report in March of <br /> 1989 (EPA-520/ 1-89-010) . <br /> A second part of the inquiry dealing with environmental issues asked <br /> about expenditures on asbestos. On June 13, 1989, the Board and I reviewed <br /> with the Commissioners in a budget work session a report of needed asbestos <br /> work which was prepared by an engineering firm, EEC, Inc. , of Raleigh. At <br /> that time the Board requested only $313,000 of the estimated amount of <br /> $846,000, and I stated that this total work should be done over two or three <br /> years. I also stated that additional requests would be forthcoming for the <br /> balance. Subsequently, the Commissioners approved the $313,000 when the <br /> 1989-90 budget was enacted. <br /> At this time we have spent approximately $86,000 of the allocation, <br /> another $37,000 * is encumbered and additional work is planned for the next <br /> seven months to utilize the balance of the $313,000. <br /> A third part of this request focused on radon testing and the results with <br /> possible action to be taken. During the Christmas break we began the testing <br /> program and have spent slightly over $1 ,000 on testing alone. The results have <br /> not been received at this time; therefore, the course of action has not been <br />
