21 <br /> I <br /> density of the subdivision, the staff determined <br /> that private roads are justified. <br /> The Concept Plan for Wyndsong was approved by the <br /> Planning Board on September 18, 1989 with a <br /> requirement for a Class A private road from <br /> Davis Road to the major fork of the road. <br /> All applicable agency comments are attached. The <br /> Health Department has located a suitable area on <br /> each lot for a septic tank and drain field. <br /> The County Attorney has reviewed the Restrictive <br /> Covenants and Road Maintenance Agreement and <br /> recommended minor changes . There was no comment <br /> on the Preliminary Plan from the County Attorney <br /> or the County Engineer. <br /> NCDOT has indicated the site distance is adequate <br /> and the intersection angle requirements may be <br /> attained by shifting the entrance inside the <br /> private road right-of-way. <br /> An Erosion Control Plan has been approved by the <br /> Orange County Erosion Control Officer. <br /> The Planning Staff recommends that the <br /> preliminary plan for Wyndsong be approved through <br /> the attached Resolution of Approval. <br /> MOTION: Best moved approval as recommended by the <br /> Planning Staff . Seconded by Boland. <br /> Yuhasz noted that since Forte Lane serves only <br /> one lot, he felt this would be a situation where <br /> a flag lot would be appropriate. Eddleman <br /> indicated agreement. Collins responded that <br /> there are only four situations where flag lots <br /> are permitted. They are: to eliminate access <br /> onto arterials , to utilize irregularly shaped <br /> lots, to utilize land with difficult topography, <br /> and to utilize land with limited septic sites . <br /> This property meets none of that criteria. <br /> Collins noted that the flag lot issue will be <br /> reviewed in the near future in conjunction with <br /> the public relations issues in process . <br /> VOTE: Unanimous . <br /> c.
