7 <br /> (This is not exactly a cluster subdivision even though <br /> most of the Iots are located in one area . This was done <br /> to preserve the natural beauty of the land, also it will <br /> preserve the spirit of clustering by allowing a large <br /> amount of open space . ) <br /> 2. The number, location and/or size of lots to be located <br /> in the subdivision are such that, even if constructed to <br /> State standards, the streets would not be accepted by <br /> the State for maintenance due to density or other State <br /> requirements; <br /> (With a total of 15 lots and 4100 feet of roads this <br /> subdivision will not qualify for State maintenance (15.5 <br /> lots) . I feel that the State would prefer that this <br /> subdivision be served by private roads to maintain the <br /> rural character. ) <br /> 3. Restrictive covenants are proposed which prevent <br /> further subdivision of the property and the same shall <br /> be made a condition of approval , thus maintaining <br /> project density; <br /> (Restrictive covenants are proposed which will restrict <br /> further subdivision of the property, including a further <br /> subdivision of any of the proposed lots. ) <br /> 4. Recreation and/or open space areas, including lands <br /> containing significant botanical , wildlife, historic <br /> and/or archaeological sites, are to be dedicated and/or <br /> preserved through restrictive covenants in amounts <br /> greater than required by standards for recreation/open <br /> space dedication; and/or <br /> (In this application we propose to preserve 14 .60 acres <br /> of open space in the common area. In this open area <br /> there is a stream that flows west, several natural <br /> springs, and a growth of low land trees. ) <br /> 5 . Larger than required stream buffers and lot sizes, <br /> and/or -other design features are proposed as part of <br /> a subdivision to be located in a Protected Watershed as <br /> designed on the Orange County Comprehensive Plan to <br /> reduce the amount of impervious surface and cause <br /> infiltration of storm water runoff to prevent the <br /> pollution of water supply reservoirs . <br /> (This property is located in a PW2 watershed for Seven <br /> Mile creek. However we feel that the design features <br /> with a large open space and a private road would reduce <br /> the amount of impervious surface, which would allow more <br /> infiltration of storm water runoff, there by providing <br /> more protection for the watershed. ) <br />
