4 <br /> III-D-2-c. Planning Board Review Procedures <br /> The Planning Board shall review the application <br /> and the Planning Department's report and shall <br /> prepare a written recommendation to the Board of <br /> Commissioners . All interested persons shall be <br /> given the opportunity to speak and ask questions <br /> regarding the application. The Planning Board <br /> may place reasonable and fair limitations on <br /> comments, arguments and questions to avoid undue <br /> delay. <br /> The Planning Board shall take action on the <br /> application solely on its findings as to <br /> compliance with applicable regulations and <br /> conditions and shall : <br /> ( 1) Recommend approval of" the application; <br /> (2 ) Recommend approval subject to conditions; or <br /> (3) Recommend denial of the application. <br /> The Planning Board shall prepare its <br /> recommendations within forty-five (45) days of <br /> the meeting at which the Planning Department's <br /> report is submitted to it or within such further <br /> time consented to in writing by the applicant. <br /> If the Planning Board fails to prepare its <br /> recommendation to the Board of Commissioners <br /> within the specified time period, or extensions <br /> thereof, the Planning Board shall be deemed to <br /> conditionc have advanced the application without <br /> recommendation. <br /> If the Planning Board approves the application <br /> subject to conditions, such conditions shall be <br /> reasonable and shall seek to insure compliance <br /> with applicable regulations and the provision of <br /> utilities and/or other facilities needed to serve <br /> the proposed development. If the Planning Board <br /> recommends approval of the application with <br /> conditions, the applicant may amend his/her <br /> application to conform to all or some of the <br /> conditions, provided the Planning Department <br /> reviews the amended application for compliance <br /> with applicable regulations and certifies that <br /> the amendments conform to the conditions of the <br /> Planning Board recommendation. In such cases, <br /> the Planning Department may amend its report to <br /> conform to any or all of the Planning Board's <br /> recommendations . The Planning Department shall <br /> then forward its report and the Planning Board's <br /> recommendation to the Board of Commissioners at <br />
