AMENDMENTS TO THE POLE ATTACHMENTS AGREEMENT <br /> 1. Change the first line of the paragraph that reads: <br /> WHEREAS, Licensee is certified to furnish telecommunication <br /> services. . . <br /> to read: <br /> WHEREAS, Licensee furnishes telecommunication services. . . <br /> 2 . Change the first sentence of section 1 to read: <br /> Licensee shall make application and receive a permit for the <br /> attachment on poles of Licensor in the form of Exhibit A hereto <br /> attached and made a part hereof. <br /> 3 . The words "shall be" in the first line of section 3 should be <br /> changed to "have been". The words "to be" in the ninth line of <br /> section 3 should be changed to "have been" . Strike the <br /> sentence beginning "Random swithching. . . " in the eleventh line of <br /> section 3 . The sentence in line thirteen of section 3 should read <br /> "Licensee's cables, wires or appliances are marked to clearly. . . " . <br /> Strike the sentence beginning "It is distinctly understood. . . " in <br /> the fourteenth line of section 3. <br /> 4. Strike in their entirety sections 5a, 5b, 5c and 5d. <br /> 5. Strike in its entirety section 8. <br /> 6. Strike the words "or damage is caused by the presence of <br /> Licensee's equipment or in Licensee's poles" from the third and <br /> fourth lines of section 14. <br /> 7. Add the phrase "to the extent authorized by North Carolina law, " <br /> to section 15 between the words "shall" and "indemnify" on the <br /> first line of section 15. <br /> 8. Strike in its entirety section 16. <br /> 11. Strike in its entirety section 27. <br />
