POLE ATTACHMENTS <br /> remove its attachment from an anchor rod if, in the future, Licensor <br /> requires the full holding power of said anchor rod. <br /> 7. Licensor reserves to itself, its successors and assigns, the right to maintain <br /> its poles and to operate its facilities thereon in such mariner as will best <br /> enable it to fulfill its own service requirements, but in accordance with the <br /> specifications hereinbefore referred to. Licensor shall nct be liable to <br /> Licensee for any interruption to service of Licensee or for interference <br /> with the operation of the cables, wire and appliances of Licensee arising in <br /> any manner out of the use of Licensor's poles hereunder. <br /> 8. Licensee represents that it has obtained all legally required authority to <br /> erect and maintain its facilities within public streets, highways, and other <br /> thoroughfares and has obtained all legally required consents from state, <br /> county, cr municipal authorities and from the owners of properly to <br /> construct and maintain facilities at the locations of poles of Licensor which <br /> it desires to use, and will hold Licensor harmless from any claims for <br /> damage or]i hility of whatever nature arising out of failure of Licensee to <br /> secure such consents, franchises, or such certificates of convenience and <br /> necessity as may be lawfully required. Licensor may require from Licensee <br /> proof of such authority and consent. <br /> 9. The Licensee shall, at its own cost and expense do such tree trim ming as it <br /> deems necessary to keep its farili*i es free of encumbrances. "Tree <br /> Trim ming" is defined as initial tree trim ming done by each party to make <br /> its own wires and fariliries free and clear in a non-uniform right-of-way <br /> situation and maintenance trim ming done to keep the wires and facilities <br /> free and clear whether the right-of-way is uniform or non-uniform. "Non- <br /> Uniform Right-of-Way" means a right-of-way where no ground clearing is <br /> required, such as along city streets, towns, and subdivisions. By mutual <br /> agreement, such tree trim ming may be done for the benefit of the two <br /> parties by one contractor. <br /> 10. Licensee shall pay to Licensor, for attachments of Licensee's equipment to <br /> Lioersor's pole, rental, at the rate aE $ 23.47 per year for each pole <br /> contacted, as hereinafter set forth.
