POLE ATTACHMENTS <br /> Specifications and in compliance with any rules or orders now in effect or <br /> that hereafter may be issued by the North Carolina Utilities Commission <br /> or other authority having j.nisdiction. Licensee's cables, wire and <br /> appliances to be placed on either side of the pole and 12" above cables, <br /> wires and appliances of Licersor as indicated on a drawing attached to the <br /> application form. Random switching from 12" above to 12" below Licensor <br /> facilities on any particular pole line will not be permitted. Licensee's <br /> cables, wires or appliances shall be marked to clearly indicate ownership at <br /> each pole. It is distinctly understood, however, that Licensor reserves the <br /> right to refuse to permit or limit the number and character of attachments <br /> on any pole or poles. <br /> 4. Licensee shall, at its own expense, make and maintain said attachments in <br /> safe condition and in thorough repair, and in a manner suitable to Licensor <br /> and so they will not conflict with the use of said poles by Licersor, or by <br /> other parties using or having reserved the right to use said poles, or <br /> interfere with the wonting use of facilities thereon or which may from time <br /> to time be placed thereon. Licensee shall at any time, at its own expense, <br /> upon five days notice from Licersor, relocate, replace, or renew its <br /> facilities placed on said poles, and transfer them to substituted poles, or <br /> perform any other work in connection with said facilities that may be <br /> required by Licensor. In the event the Licensee fails to relocate, replace <br /> or renew its facilities after five days and in cases of emergency, or the <br /> need to provide prompt service to a customer, Licensor may relocate, <br /> replace, or renew the facilities of Licensee, transfer them to substituted <br /> poles or perform any other work in connection with said fatalities that may <br /> be required in the maintenance, replacement, removal or relocation of said <br /> poles, the facilities thereon or which may be placed thereon, or for the <br /> service needs of Licensor, and Licensee shall, on demand, reimburse <br /> Licensor for the full cost and expense thereby incurred. <br /> 5a. In the event that Licensor determines that any pole or poles of Licensor to <br /> which Licensee desires to make attachments are inadequate to support the <br /> additional facilities in accordance with the aforesaid specifications, <br /> Licensor will indicate on said Exhibit A the changes necessary to provide <br /> adequate poles and the estimated cost thereof to Licensee and return it to <br />
