CONDUrr FACILTIE5 <br /> accordance with the aforesaid specifications, Licensor will indicate on said <br /> Exhibit A the changes necessary to provide adequate underground conduit <br /> space and the estimated cost thereof to Licensee and return it to Licensee <br /> and if Licensee still desires to make the placements and returrs the E xhihit <br /> A marked to so indicate together with payment of the estimated cost, <br /> Licensor will replace such section or sections of conduit with suitah1P <br /> conduit. Where Licensee's desired placements can be accom modated in <br /> present ducts of Licensor by rearranging Licersor's facilities therein, and <br /> Licensee pays to Licensor the estimated cost of such rearrangements, <br /> Licensor will so rearrange its facilities. <br /> 5b. All charges for engineering, rearrangements, and removal of Licensee's <br /> facilities from Licersor;s conduit system shall be based upon the full cost <br /> and expense to Licersor for performing such work. The cost to Licensor <br /> shall be determined by the regular and customary methods used by Licensor <br /> in determining such costs. Licensor shall refund, or Licensee shall pay, as <br /> the case may be, any difference between estimated cost advanced by <br /> Licensee under paragraph 5a and actual cast as determined by Licensor. <br /> 5c. The charge for replacement of section or sections of conduit shall include <br /> the increased cast of the conduit, the undepreci.ated value of conduit <br /> removed, the cast of removal less any salvage recovery, and the expense of <br /> transferring Licensor's facilities from the old to new conduit. <br /> 5d. Licensee will also on demand reimburse the owner of other facilities placed <br /> within said conduit system for any expense incurred by it or them in <br /> transferring or rearranging said facilities. <br /> 6. Licensor reserves to itself, its success= and artsâ–ş the right to maintain <br /> its conduit system and to operate its facilities therein in such manner as <br /> will best enable it to fulfill its own service requirements, but in accordance <br /> with the specifications hereinbefore referred to. Licersor shall not be <br /> liable to Licensee for any interruption to service of Licensee or for <br /> interference with the operation of the cable facilities and associated <br /> equipment, of Licensee arising in any manner out of the use of Licersor's <br /> conduit system hereunder. <br />
