C O N D Ufl FACILITIES <br /> 3. Licensee's cable farilities and associated equipment, in each and every <br /> location, shall be placed within the applicable practices and specifications <br /> of the Licensor and in compliance with any rules or orders now in effect or <br /> that hereafter may be issued by the North Carolina Utilities Corn mission or <br /> other authority having juriPdiction. Licensor's specifications shall require <br /> that Licensee's cable facilities be irst4Ped in the conduit with sub-ducting <br /> enclosing said cable facilities. Licensees cable facilities and associated <br /> equipment shall be marked to clearly indicate ownership in each manhole. <br /> lb is distinctly understood, however, that Licensor reserves the right to <br /> refuse to permit or limit the occurrence and character of said placement in <br /> any section or sections of the L.icensor's underground conduit system. <br /> 4. Licensee shall" at its own expense, make and maintain said placements in <br /> safe condition and in thorough repair, and in a manner suitable to Licensor <br /> and so they will not conflict with the use of said underground conduit <br /> system by Licensor, cr by other parties using er having reserved the right <br /> to use said system, or interfere with the working use of facilities therein or <br /> which may from time to time be placed therein. Licensee shall at any <br /> time, at its own expense, upon thirty (30) days notice from Licersor, <br /> relocate, replace, or renew its facilities placed in said conduit system, and <br /> transfer them to substituted ducts within the Licersox's conduit system or <br /> perform any other work in connection with said facilities that may be <br /> required by Licersor; provided, however, that in cases of an emergency, or <br /> the need to provide prompt service to a customer, Licensor may relocate, <br /> replace, or renew the facilities of Licensee, transfer them to substituted <br /> ducts ar perform any other work in connection with said facilities that may <br /> be required in the maintenance, replacement, removal, or relocation of said <br /> conduit system the facilities therein or which may be placed therein, or for <br /> the service needs of Licensor, and Licensee shall, on demand, reimburse <br /> Licensor for the full cast and expense thereby incurred. <br /> 5a. In the event that Licensor determines that any section or sections of the <br /> underground conduit system of Licensor to which Licensee desires to make <br /> placements are inadequate to support the additional facilities in <br />
