,o <br />POLICY 4.11, "ACQUIRED IMMUNE DEFICIENCY SYNDROME (AIDS)" <br />PAGE :3 OF 8 <br />4. Screening of New Admissions: <br />A. Pursuant to the procedures outlined in Orange County .Jail Policies Z.il, <br />"Preliminary Health Screening," and 4.14, "Medical Records," the admitting detention <br />officer will be responsible for making a visual inspection of each newly admitted inmate <br />and for reporting any noted observations or any statements made by the inmate that may <br />suggest or confirm that the inmate has HIV or AIDS. <br />B. The procedures concerning confidentiality and filing of any information pertaining <br />to an inmate either believed or admitting to being infected with AIDS or' HIV outlined in <br />Orange County .Tail Policies 2,11 and 4.14, noted above, will be strictly adhered to by all <br />jail officers. Information of this type is considered to be strictly confidential. Any <br />officer who is found to be disclosing this information to another individual will be <br />subject to disciplinary action. Under no circumstances will any information either <br />suggesting or diagnosing an inmate to be HIV+) or AIDS infected be included in the <br />inmate's confinement record. Rather, all such information will be placed in the <br />inmate's confidential medical record ONLY. <br />5. Testing of Inmates for HIV/AIDS Infection: <br />A, The routine testing of newly admitted inmates for HIV infection or AIDS will be <br />strictly prohibited. <br />B. The contract medical physician may request an immate to consent to receive a test <br />for HIV or AIDS if he/she feels that the test is necessary for the appropriate treatment of <br />the inmate. Testing will not be conducted, however, should the inmate refuse the test <br />(NOTE:) The contract physician should have the inmate sign a refusal of treatment form <br />for' filing in the inmate's medical record should the inmate refuse to be tested). <br />C. The contract health care physician can require an inmate to submit to a test ro <br />detect HIV or AIDS should an inmate, detention officer or other person be exposed to the <br />inmate's blood or body fluid and it is felt that the exposure poses a threat/risk of <br />transmitting HIV or AIDS,. Should an inmate refuse to be tested, the contract physician <br />may obtain a court order to require the inmate to be tested or the physician may make all <br />reasonable attempts to contact the inmate's previous physician to determine the status of <br />the inmate. <br />
