Attachment 3 19 <br />Comments from the towns of Chapel Hill and /or Carrboro regarding applications <br />to rezone parcels subject to the Courtesy Review Process as specified in the <br />Joint Planning Agreement, in accordance to Section 20A.5.4, shall also be <br />forwarded to the Board. <br />The Board of County Commissioners shall hear applications for amendments to <br />the zoning atlas to establish AS -CD in a Public Hearing at any of the County <br />Commissioners' regular meetings, so long as the provisions for published and <br />written notice in sections 20A.5.6 have been met, The Board of County <br />Commissioners may invite the Planning Board, Agricultural Preservation Board <br />and /or Economic Development Commission to participate in the public hearing <br />for AS -CD applications. <br />20A.5.6 Public Hearing and Notice Thereof <br />20A.5.6.1 A public hearing shall be held by the Board of County Commissioners before <br />adoption of any proposed amendment to this ordinance. Notice of the public <br />hearing shall be given by publishing said notice at least twice in a newspaper of <br />general circulation in the County, stating the time and place of such hearing and <br />the substance of the proposed amendment. This notice shall appear in said <br />newspaper for two successive weeks with the first notice appearing not less than <br />ten (10) days nor more than twenty -five (25) days before the date set for the <br />public hearing. In computing the notice period, the day of publication is not to be <br />included, but the day of the hearing is to be included. <br />20A.5.6.2 The Zoning Officer in the case of amendments to the zoning atlas shall post on <br />the applicant's affected property a notice of the public hearing at least ten (10) <br />days prior to the date of said hearing. <br />20A.5.6.3 In the case of amendments to the Zoning Atlas, written notice shall be sent by <br />certified mail to the affected property owner and all adjacent property owners not <br />less than fifteen (15) days before the hearing date. Adjacent property owners are <br />those whose names and addresses are currently listed in the Orange County tax <br />records and whose property lies within five hundred (500) feet of the affected <br />property. <br />If amendments to the Zoning Atlas are proposed by the County, notice shall be <br />sent by first class mail to all affected property owners and to all adjacent property <br />owners within five hundred (500) feet as provided above. <br />The Zoning Officer shall certify the mailing of all such notices to the Board of <br />County Commissioners. <br />20A.5.7 Action at or Subsequent to Public Hearing <br />The Board of County Commissioners shall decide at the conclusion of the public <br />hearing to approve, approve with conditions, or deny the application to amend <br />the Zoning Atlas to establish the Agricultural Service Conditional District. <br />20A.5.7.1 The County Commissioners may chose to continue the public hearing to gather <br />additional information and /or to request formal recommendation(s) from the <br />Planning Board, Agricultural Preservation Board and /or Economic Development <br />Commission on the application, The Planning Board, Agricultural Preservation <br />Board and /or Economic Development Commission shall submit comments to the <br />County Commissioners in accordance with the schedule outlined at the hearing. <br />20A -19 <br />
