5A <br />City of Cuyahoga Falls, Ohio 31 <br />88 0 88 Analysis of Impediments to Fair Housing Choice <br />The court said that this definition of family violates the federal fair housing regulations (42 <br />USC 3604(f)(3)(b). The majority of the court found that the open -ended numerical potential <br />of a traditionally nuclear family is so much greater than the limit of five unrelated persons, <br />that the city was not making a reasonable accommodation for disabled individuals. <br />Considering the impact of the Fair Housing Amendments Act of 1988, the Uniform Federal <br />Accessibility Guidelines, Section 504 of the Rehabilitation Act of 1973 and the Americans <br />with Disabilities Act, entitlement grantees must exercise extraordinary diligence in their <br />efforts to conform their policies and procedures to the ever - evolving requirements of the <br />law. This is especially true with regard to zoning and building regulations, where <br />developers rely upon grantees to establish the boundaries within which they can operate. <br />As far as can be determined, the City of Cuyahoga Falls conducts their housing programs <br />in an affirmative manner and without restrictive policies that would adversely affect <br />members of the protected classes. <br />6.3 Local Review of Zoning Codes <br />The City of Cuyahoga Falls provided a number of documents regarding local zoning: <br />Sign & Landscaping Code 2003 <br />Zoning Regulations July 2005 <br />Planning and Zoning Code - Proposed - 2005 <br />For the purpose of this report we focused our review on the new proposed planning and <br />zoning code, particularly the definitions and Chapter's 1131 and 1132. Our review of the <br />Sign and Landscaping code found no issues as they relate to housing or the provision of <br />housing that would be considered discriminatory. <br />In our limited review of the documents we could find no issues with lot sizes, setbacks, etc. <br />in the proposed planning and zone code that possibly would be discriminatory. Any <br />concerns that we did have since been addressed in the new codes. <br />7.0 HOME MORTGAGE LENDING ACTIVITY <br />The American dream is one of achieving self - sufficiency and success both economically <br />and personally. Home ownership is an element of economic and personal success. <br />Freedom to own a home is the right of all people and yet, housing discrimination has been <br />the hardest of the many civil rights issues to overcome. <br />At the heart of housing discrimination is the issue of mortgage lending. The issue of color, <br />race, national origin, sex, religion, familial status or disability can still shut the door to home <br />
