Benedict, Director, 919-245- <br /> Exhibit A: Orange County/ Town of 2592 <br /> Hillsborough Joint Land Use John Roberts, Attorney, 919-245-2318 <br /> Map Travis Myren, Deputy County Manager, <br /> Exhibit B: Hillsborough Area 919-245-2308 <br /> WASMPBA Designations <br /> Map <br /> PURPOSE: To review and approve the interlocal agreement with the Town of Hillsborough that <br /> sets forth conditions of utility installation and operation with associated land use consistency <br /> with prior cooperative planning efforts. <br /> BACKGROUND: Orange County and the Town of Hillsborough have been coordinating <br /> planning efforts around the common interest land fringes of the Town of Hillsborough since <br /> 2002. These efforts led to more a formalized 2007 acceptance of an area `Strategic Growth <br /> Plan' and the pursuit of an interlocal agreement that proposed additional implementation steps <br /> by both local governments. The Interlocal Agreement between Orange County and the Town of <br /> Hillsborough for construction and operation of water and sewer facilities in the Hillsborough Area <br /> Economic Development District of Orange County was presented at the May 2, 2017 Board of <br /> County Commissioners meeting. <br /> Following this meeting, the attorney for the Town of Hillsborough suggested modifications to the <br /> agreement to further define how the determination of capacity is made by the Town. This <br /> includes consistency with Hillsborough's adopted Future Land Use Plan for the specific area in <br /> the southwest quadrant and further limits connections to "industrial and commercial". In addition, <br /> the word "only" was deleted from Section 4 which allows the consideration of "other aspects <br /> outlined herein" (such as land use, reservation period, etc.) to be operative instead of "only" a <br /> capacity determination. <br /> This agreement does not include proposed expansions to the WASMPBA primary area, if <br /> approved, which were primarily (over 80%) in the southeast quadrant. The proposed agreement <br /> is included in Attachment 1. The agreement was presented and approved at the Hillsborough <br /> Board of Commissioners meeting on September 25, 2017. <br />
