Section 6. Establishes several directives to SHP employees concerning fraud detection and <br /> audit programs. <br /> G.S. 135-48.16. <br /> Section 9. Clarifies that if a person who has been given an erroneous payment through <br /> TSERS or a claim through SHP and that person is later found to not be entitled to those payments, <br /> the erroneous payment/claim can be offset against retirement allowance,return of contributions, or <br /> other right accruing to the person,the person's estate, or designated beneficiary (formerly, only <br /> applied to overpayments,not erroneous payments). <br /> G.S. 135-9. <br /> Local Legislation <br /> House Bills <br /> HB 55: Apex/Cary/Police Assistance on School Grounds (S.L. 2017-34) <br /> Authorizes the Apex Police Department to assist in law enforcement matters at Apex High School <br /> while it is temporarily located in Cary. <br /> Expires July 1, 2020. <br /> G.S. 160A-288.2A <br /> HB 393: Mebane Charter/Alamance-Burl BOE Exchange (S.L. 2017-82) <br /> Section 11. Authorizes the Alamance-Burlington Board of Education to convey, sell, or <br /> transfer a tract of property where an elementary school is located through a private negotiation and <br /> sale. Directs the board to adopt a resolution providing for the execution and performance of this <br /> agreement at a regular board meeting upon 10 days'public notice. Stipulates what the agreement <br /> may provide. <br /> HB 406: Repeal Orange County Impact Fees (S.L. 2017-36) <br /> Revokes authority for the Orange County Board of Commissioners to place impact fees on <br /> development in the county. <br /> *Note that this will impact revenue coming into the Orange County budget for all purposes, <br /> including for the public school systems.* <br /> HB 447: Lexington City Bd. Of Ed./City Council (S.L. 2017-61) <br /> Changes how the Lexington City Schools Board of Education is structured and selected as follows: <br /> Selection Method <br /> Changes how board members are selected from being appointed by the City Council to being <br /> elected in nonpartisan plurality elections starting in 2017. Establishes that the elections will be held <br /> at the time of the November general election in odd-numbered years. Provides that new members are <br /> to take office the first Monday in December following the election. <br /> Sets up schedule for elections to stagger in newly elected members. <br /> Composition <br /> Reduces the number of board members from 9 to 7. There will be 6 members from each of <br /> the City of Lexington's Wards and 1 from outside Lexington but still within the LEA. <br /> Length of Terms <br /> Lengthens terms of board members from 3 years to 4 years. <br /> 50 <br />
