Clarifies that an injured employee who is awarded Workers' Comp benefits <br /> has the burden of proving that any additional medical conditions the employee later develops are <br /> causally related to the injury for which the employer is liable. By putting this language into <br /> statute it reverses the NC Supreme Court decision in Wilkes v. City of Greenville, which had <br /> shifted to the employer the burden of proving new medical conditions are not causally related to <br /> the injury. <br /> Applies to claims accrued or pending prior to, on, or after that date. <br /> G.S. 97-82(b). <br /> HB 115: Retirement Technical Corrections Act of 2017- AB (S.L. 2017-125) <br /> Section 1. Clarifies that in the definition of"average final compensation"for retiree <br /> benefits, vacation leave is only included if the payout is received by the member during the four <br /> consecutive calendar years of membership service producing the highest average annual <br /> compensation. <br /> G.S. 135-1(5). <br /> Section 2. Clarifies that creditable service may be purchased when the member is on <br /> educational leave for a full-time degree program where he or she receives a stipend. <br /> G.S. 135-(8)(b)(5). <br /> HB 159: Charter School TSERS Election (S.L. 2017-98) <br /> Extends the time a charter school has to elect to participate in TSERS from 1 year to 2 years. <br /> Effective August 1, 2017. <br /> HB 176: Pensions Integrity Act of 2017-AB (S.L. 2017-128) <br /> Section 2. Extends from 12 months to 15 months the length of time employers could <br /> arrange for an interest-free installment plan if they are assessed under the anti-pension spiking <br /> legislation.
