5 <br />4. There are no State natural areas within a mile of the site. Is there a County natural area <br />or historic site nearby? <br />• There is a natural area of County significance about one mile south of the school <br />site located on Orange County owned land known as Blackwood Farm (a future <br />park site). The natural area is 18 acres in size and known as New Hope Church <br />Road Basic Forest. Blackwood Farm also includes an historic farmstead with a <br />house that dates back to 1828. <br />5. What is the timeline between Phase I and Phase 2? <br />Mike Hammersley indicated probably 3 -5 years. <br />SECTION 8.2.1 BOCC TO MAKE A FINDING OF PUBLIC NECESSITY: <br />The ordinance requires: <br />a) _ .evidence that it meets general and specific conditions. _ ; and <br />b) three general findings: <br />1) ...health safety and general welfare.. ; <br />2) The use will maintain or enhance the value of contiguous property (unless the <br />use is a public necessity, in which case the use need not maintain or enhance <br />the value of contiguous property); <br />3) The location, character of use. will be in harmony with surroundings.. <br />In regard to Item 2) above in the February 27, 2006 Public Hearing the BOCC made <br />a finding that the alternative school is a public necessity which exempts the <br />applicant from the evidentiary requirement that the use must maintain or enhance <br />the value of contiguous properties. <br />Information /Issues at Public Hearing on February 27, 2006 <br />1. <br />Concerns raised about proximity of proposed recreation facilities in Phase 2 to <br />neighboring properties with regard to noise, lights, drainage and not enough <br />wooded buffering. <br />Phase 2 has been withdrawn by the applicant. <br />2. <br />No funding at this time for proposed Phase 2. <br />Phase 2 has been withdrawn by the applicant. <br />3. <br />There will be no intermingling of Alternative students and Stanback students. <br />This was indicated by a school board representative in the public <br />hearing. This issue does not pertain to the application for approval of the <br />Special Use. <br />4. <br />Could be 100 students at the Alternative School if the site is extended to full <br />development. <br />The site was designed to accommodate this many students when the <br />future addition is made to the building. <br />5. <br />Clearer definition of types of students that will be attending the School. <br />Representatives from the school board indicated it will be the same <br />students and types of students that go to the school now operated in <br />town. This issue does not pertain to the application for approval of the <br />Special Use. <br />6. <br />The State has Erosion Control responsibility for the site. <br />Orange County Erosion Control Officers will periodically monitor the <br />construction site and inform state officials if the situation warrents. <br />7. <br />BOCC made a finding that the School is a public necessity. <br />This makes it unnecessary for there to be a finding that the use must <br />maintain or enhance the value of contiguous properties. <br />
