S3 <br /> and any trustee so appointed shall be vested with the title to the <br /> III <br /> Mortgaged Property and shall possess all the powers, duties and <br /> obligations herein conferred on the Deed of Trust Trustee in the <br /> same manner and to the same extent as though he were named herein <br /> as Deed of Trust Trustee. <br /> SECTION 7 <br /> Miscellaneous <br /> 7 . 1 Limitation of Liability of Officers of Grantor. No <br /> covenant, condition or agreement contained herein shall be deemed <br /> to be a covenant, agreement or obligation of a present or future <br /> commissioner, officer, employee or agent of the Grantor in his or <br /> her individual capacity, and no officer thereof shall be liable <br /> personally on the Bonds or any Additional Bonds or be subject to <br /> any personal liability or accountability by reason of the execution <br /> and delivery thereof or by virtue of the execution and delivery of <br /> this Deed of Trust . No commissioner, officer, employee or agent of <br /> the Grantor shall incur any personal liability with respect to any <br /> other action or failure to act pursuant to this Deed of Trust, <br /> provided such officer, employee or agent acts in good faith. <br /> 7.2 Notices. All notices, approvals, consents, requests and <br /> other communications hereunder shall be in writing and given by <br /> first-class mail, postage prepaid, or personal delivery to the <br /> party entitled thereto, addressed (i) if to the Grantor, to <br /> , North Carolina , Attention: <br /> (ii) if to the Deed of Trust Trustee, to , <br /> , North Carolina , and (iii) if to the Beneficiary, <br /> to , <br /> Charlotte , North Carolina , Attention : <br /> Each party may by notice given <br /> hereunder designate any further or different addresses to which <br /> subsequent notices, approvals, consents, requests or other <br /> communications shall be sent or persons to whose attention the same <br /> shall be directed. Notice shall be deemed to have been received <br /> upon the earlier of actual receipt or five Business Days (as <br /> defined in the Trust Indenture) after deposit in the United States <br /> mail, in certified form, postage prepaid, or, in the case of <br /> personal delivery, upon delivery to the respective address set <br /> forth above. All communications to be given hereunder may also be <br /> given by telephone, telecopy or other electronic means and shall be <br /> deemed to have been properly given at the time of the transmission <br /> thereof if, and only if, such transmission shall be confirmed in <br /> writing and sent as specified above. <br /> 7.3 Amendments. This Deed of Trust may be amended in any <br /> respect, subject to compliance with the provisions of Article of <br /> the Trust Indenture. <br /> 8 <br />
