<br /> Easement Area 2 is situated on GRANTOR'S Tract G, as identified on that
<br /> certain plat recorded in Plat Book 83, Page 147, and acquired by Seven
<br /> Mile Farm, LLC by general warranty deed dated January 31, 2000
<br /> recorded in Book 2037, Page 91 (PIN #9844831368), LESS AND
<br /> EXCEPT any outconveyances, and is designated as a 30' permanent
<br /> easement shown on that certain "Easement Plat for Orange County, North
<br /> Carolina on the Property of: Seven Mile Farm, LLC dated July 21, 2015
<br /> surveyed by Robert E. Leach, III, and platted at Book , Page ,
<br /> to which reference is made for a more detailed description of the metes,
<br /> bounds and courses of Easement Area 2.
<br /> Easement Area 3 is situated on GRANTOR'S Tract G as identified on that
<br /> certain plat recorded in Plat Book 83, Page 147, and acquired by Seven
<br /> Mile Farm, LLC by general warranty deed dated January 31, 2000
<br /> recorded in Book 2037, Page 91 (PIN #9844831368), LESS AND
<br /> EXCEPT any outconveyances, as depicted on attached Exhibit A.
<br /> The easement conveyed herein authorizes DEC to construct, reconstruct, operate,
<br /> patrol, maintain, inspect, repair, replace, relocate, add to, modify and remove electric
<br /> and/or communication facilities thereon including but not limited to, supporting
<br /> structures such, as poles, cables, wires, guy wires, anchors, and other appurtenant
<br /> apparatus and equipment (the "Facilities") within Easement Areas 1, 2 and 3 for the
<br /> purpose of transmitting and distributing electrical energy and for communication
<br /> purposes of DEC and Incumbent Local Exchange Carriers.
<br /> The right, privilege and easement shall include the following rights granted to
<br /> DEC: (a) to trim and keep clear from the Easement Areas, now or at any time in the
<br /> future, trees, limbs, undergrowth, structures or other obstructions, and to trim or clear
<br /> dead, diseased, weak or leaning trees or limbs outside of the Easement Areas which, in
<br /> the opinion of DEC, might interfere with or fall upon the Facilities; and (b) within the
<br /> Easement Areas, all other rights and privileges reasonably necessary or convenient for
<br /> DEC's safe, reliable and efficient installation, operation, and maintenance of the
<br /> Facilities and for the enjoyment and use of the Easement Areas for the purposes
<br /> described herein.
<br /> TO HAVE AND TO HOLD said rights, privilege, and easement unto DEC, its
<br /> successors, licensees, and assigns, forever, and GRANTOR, for itself, its successors
<br /> and assigns, covenants to and with DEC that GRANTOR is the lawful owner of Tracts D
<br /> and G identified above and the Easement Areas in fee and has the right to convey said
<br /> rights and easement.
<br /> IN WITNESS WHEREOF, this EASEMENT has been executed by GRANTOR
<br /> and is effective as of the Effective Date herein.
