PROPOSED ADDITION TO THE AGENDA AS ITEM- I I-F <br /> o The Board was unaware of the existence of the Board of Health bylaws that <br /> prohibit the appointment of former health department employees to the Board of <br /> Health; <br /> o The Board acknowledges that the bylaws are not binding upon the Board's <br /> appointment process; <br /> o The Board, however, desires to remain in compliance with the bylaws to avoid any <br /> unnecessary conflicts among Board of Health members or between Board of <br /> Health members and the health department and its employees; <br /> o Dr. Barber has not taken the oath of office associated with membership on the <br /> Board of Health or assumed any duties related to such membership and has <br /> therefore not officially been appointed to that board; <br /> o For these reasons the original appointment of Dr. Barber to the Board of Health is <br /> rescinded. <br /> During the County Attorney's research on this issue and these options a professor at the School <br /> of Government opined that provisions of the Board of Health's bylaws that have the appearance <br /> of conflicting with state law should be amended. The County Attorney has recommended to the <br /> Interim Health Director that the bylaws regarding the appointment process be amended to <br /> include a specific statement that they are advisory in nature and do not govern the Board of <br /> Commissioners' ultimate appointment authority. <br /> POSITION NO. Ensure that Orange County <br /> residents are able to engage government through voting and volunteering by eliminating <br /> disparities in participation and barriers to participation. <br /> RECOMMENDATION(S): The Manager recommends that the Board discuss/consider this <br /> appointment to the Board of Health. <br />
