Benedict, Planning & <br /> Inspections Director, 919-245-2592 <br /> John Roberts, Staff Attorney, 919-245- <br /> 2318 <br /> Travis Myren, Deputy County Manager, <br /> 919-245-2308 <br /> PURPOSE: To rescind approval of and void the interlocal agreement with the Town of <br /> Hillsborough that sets forth conditions of utility installation and operation with associated land <br /> use consistency with prior cooperative planning efforts; and authorize the County Manager, <br /> County Attorney, and staff to continue to negotiate the interlocal agreement with the Town of <br /> Hillsborough over the summer break and present a new proposed agreement for consideration <br /> at a future Board meeting. <br /> BACKGROUND: Orange County and the Town of Hillsborough have been coordinating <br /> planning efforts around the common interest land fringes of the Town of Hillsborough since <br /> 2002. These efforts led to more a formalized 2007 acceptance of an area `Strategic Growth <br /> Plan' and the pursuit of an interlocal agreement that proposed additional implementation steps <br /> by both local governments. The Interlocal Agreement between Orange County and the Town of <br /> Hillsborough for construction and operation of water and sewer facilities in the Hillsborough Area <br /> Economic Development District of Orange County was presented and approved at the May 2, <br /> 2017 Board of County Commissioners meeting. Agenda materials from the May 2, 2017 Board <br /> of County Commissioners meeting can be viewed at: <br /> http://server3.co.orange.nc.us:8088/weblink8/0/doc/46399/Pagel.aspx. <br /> Following this meeting, the attorney for the Town of Hillsborough suggested some modifications <br /> to the agreement adopted by the BOCC on May 2. The attorney for the Town and Town staff <br /> are also still reviewing the document in whole and the Town of Hillsborough Board of <br /> Commissioners has not approved or signed the agreement. For this reason the County <br /> Attorney is recommending the County Board of Commissioners rescind the May 2, 2017 <br /> approval of and void the interlocal agreement with the Town of Hillsborough, with the plan that <br /> the County Manager, County Attorney, and staff will continue negotiating the interlocal <br />
