17 <br /> 1 <br /> 2 VOTE: UNANIMOUS <br /> 3 <br /> 4 A motion was made by Commissioner Burroughs, seconded by Commissioner McKee to <br /> 5 close the public hearing. <br /> 6 <br /> 7 VOTE: UNANIMOUS <br /> 8 <br /> 9 Chair Dorosin said this is an unfortunate situation, and the County is at the hands of the <br /> 10 legislature. <br /> 11 Commissioner Jacobs said the Planning Staff and the Attorney reviewed the previous <br /> 12 iteration to insure its fairness and accuracy. <br /> 13 <br /> 14 <br /> 15 RES-2017-031 Attachment 2 <br /> 16 <br /> 17 RESOLUTION OF AMENDMENT <br /> 18 <br /> 19 AN ORDINANCE AMENDING CHAPTER 24 OF THE ORANGE COUNTY <br /> 20 CODE OF ORDINANCES AND A RESOLUTION REPEALING RESOLUTIONS <br /> 21 2016-083 AND 2017-018 <br /> 22 <br /> 23 <br /> 24 WHEREAS, the State of North Carolina authorizes Orange County to impose impact fees <br /> 25 through Title VI of Chapter 460 of the Session Laws of 1987, as amended by Chapter 324 of <br /> 26 the Session Laws of 1991 and Part 4 of Chapter 642 of the Session Laws of 1993; and <br /> 27 <br /> 28 WHEREAS, the General Assembly is considering amending the County's authority to impose <br /> 29 impact fees through House Bills 406 and 436; and <br /> 30 <br /> 31 WHEREAS, in order to study how best to remain in compliance with the proposed laws and to <br /> 32 study issues raised by the General Assembly and collect further data; and <br /> 33 <br /> 34 WHEREAS, the Orange County Board of Commissioners, believing it to be in the best interest <br /> 35 of the citizens and residents of Orange County, hereby determines that Chapter 30 of the <br /> 36 Orange County Code of Ordinances should be amended to repeal the impact fee amounts <br /> 37 adopted on November 15, 2016 and . <br /> 38 <br /> 39 NOW THEREFORE BE IT ORDAINED that the Code of Ordinances, Orange County, North <br /> 40 Carolina, Chapter 30, by majority vote of the Orange County Board of Commissioners, is <br /> 41 hereby amended by amending section 30-33, which section reads as shown in the attached <br /> 42 revised ordinance amending the Educational Facilities Impact Fee in Orange County. <br /> 43 <br /> 44 BE IT FURTHER RESOLVED, that Resolutions 2016-083 and 2017-018 adopted on December <br /> 45 13, 2016 and April 4, 2017, respectively, are hereby repealed. <br /> 46 <br /> 47 BE IT FURTHER RESOLVED that the County Manager is authorized to refund that portion of <br /> 48 any impact fees paid between January 1, 2017 and May 16, 2017 that exceeds the amount of <br /> 49 impact fees that would have been paid for the same project on January 1, 2012. <br /> 50 <br />
